Resolution Authorizing Execution of a Deed of Easement for Water Pipeline Over Property Owned by the City of Hampton Located at 1911 W. Pembroke Avenue (LRSN 1003141) and Granted to the City of Newport News to Allow the Installation and Maintenance of a Water Main and Other Appurtenances

 

Purpose

PURPOSE/BACKGROUND:

The City owns property located at 1911 W. Pembroke Avenue (LRSN 1003141) (the “Property”), which is the site for the new Hampton Fire Station #3.  To provide water services to the new fire station, the City of Newport News, Virginia requests a 4,637 ± square foot, or 0.1065 ± acre, easement for locating, placing, laying and maintaining water mains, pipes, laterals and appurtenances through, along the strip of land on the Property as depicted on the Plat of a Water Main Easement Projecting onto #1911 Pembroke Avenue Hereby Conveyed to the City of Newport News, Virginia from the City of Hampton, Virginia attached to the Deed of Easement for Water Pipeline. City staff recommends approval of the easement.

Body

                      WHEREAS, the City of Hampton (“City”) is the owner of a certain parcel of property designated as 1911 W. Pembroke Avenue (LRSN 1003141) (the “Property”);

 

                     WHEREAS, the City is constructing the new Hampton Fire Station #3 on the Property; 

 

                     WHEREAS, the City’s project requires water services to the Property which the City of Newport News, Virginia has agreed to provide in exchange for an easement over the area where the water pipeline will be located;

 

                     WHEREAS, accordingly, the City of Newport News, Virginia has requested that the City grant an easement for use of an approximately 4,637 ± square feet, or 0.1065 ± acres, for locating, placing, laying and maintaining water mains, pipes, laterals and appurtenances, through, along and under the Property (the “Easement”);

 

                     WHEREAS, the Easement is shown on that certain plat entitled, “Plat of a Water Main Easement Projecting onto #1911 W. Pembroke Avenue Hereby Conveyed to the City of Newport News, VA by the City of Hampton, VA”, dated August 14, 2023, a copy of which plat is attached to the proposed DEED OF EASEMENT FOR WATER PIPELINE (the “Deed”) as Exhibit “A,” which said Deed is attached hereto for City Council’s review and approval; and

 

                     WHEREAS, the City finds that dedication of the Easement to facilitate construction of the above-described improvements is in the best interest of the City of Hampton and its citizens.

 

                     NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

That the City Manager, or her authorized designee, is authorized to execute the Deed and/or other documents and plats in substantially the same form and content as that which is attached to this Resolution; to execute any other related documents; and to perform other such actions as may be necessary or desirable for the purposes identified herein and that may be necessary to effectuate the intent of this Resolution, all being subject to approval of the City Attorney.
