Ordinance Vacating a Portion of a Certain Forty-Four Foot (44') Wide Unimproved Right-of-Way Designated as Barrack Street, Containing a Total of Approximately 0.3093 +/- Acres, or 13,474 +/- Square Feet, Abutting Parcels Owned by the City of Hampton and Designated as LRSNs 7000147 and 7000165, Thereby Creating a Single Parcel of Land
Purpose
PURPOSE/BACKGROUND:
Approval of this Ordinance would vacate, pursuant to Section 2.05 of the City of Hampton (the "City") Charter, an unimproved portion of Barrack Street totaling approximately 0.3093 +/- acres (13,474 +/- square feet), abutting City-owned parcels designated as LRSNs 7000147 and 7000165 (the "Barrack Street Vacation Area"). There are no other property owners abutting the Barrack Street Vacation Area. Because the City is the sole owner of all property abutting the Barrack Street Vacation Area, no separate vacation agreement among abutting property owners is necessary. This portion of Barrack Street is unimproved, is no longer used for public access, and is no longer required for a public purpose.
The two City-owned parcels and the Barrack Street Vacation Area are subject to a Purchase & Development Agreement with Bonaventure Development for the development of Phase II of Pinnacle Apartments, which agreement City Council approved at its September 9, 2026 meeting. Vacation of the unimproved right-of-way will allow the two City-owned parcels and the former right-of-way to be consolidated into a single parcel, thereby facilitating the planned development.
Upon recordation of the Vacation Plat, the Barrack Street Vacation Area will be vacated and consolidated with the two City-owned parcels, and the resulting parcel will be known as "LOT 12B" and will contain approximately 4.0257 +/- acres (175,360 +/- square feet), as shown on the Vacation Plat.
Discussion:
The proposed vacation will facilitate the efficient use and redevelopment of City-owned property. The Barrack Street Vacation Area is unimproved, is no longer used or needed for public access, and is no longer required for a public purpose. The City owns all property abutting the Barrack Street Vacation Area. Upon recordation, the Vacation Plat will vacate the unimproved portion of Barrack Street and consolidate the vacated area with the two abutting City-owned parcels, thereby creating a single, contiguous City-owned parcel.
The consolidated parcel is currently contemplated for development as Phase II of Pinnacle Apartments pursuant to the Purchase & Development Agreement between the City and Bonaventure Development, which City Council approved on September 9, 2026.
Impact:
Approval of this Ordinance supports the City's economic and community development objectives by eliminating an unimproved public right-of-way that is no longer required for a public purpose and consolidating City-owned property into a single parcel suitable for redevelopment or other future use.

WHEREAS, the City of Hampton, Virginia (the "City") owns the parcels designated as LRSNs 7000147 and 7000165, which abut a certain forty-four foot (44') wide unimproved portion of public right-of-way designated as Barrack Street, containing approximately 0.3093+/- acres, or 13,474+/- square feet (the "Barrack Street Vacation Area"), as shown on that certain plat entitled "Plat Showing Right-of-Way Vacation of a Portion of Barrack Street, Hampton, VA", dated February 18, 2026, and attached hereto as Exhibit A (the "Vacation Plat");
WHEREAS, Barrack Street is shown on a plat recorded in the Clerk's Office of the Circuit Court of the City of Hampton, Virginia, in Miscellaneous Map Book 7, at page 92;
WHEREAS, the City is the sole owner of the property abutting the Barrack Street Vacation Area;
WHEREAS, the Barrack Street Vacation Area is unimproved, is no longer used for public access, and is no longer required for a public purpose;
WHEREAS, Section 2.05 of the Charter of the City of Hampton authorizes vacation of a street, alley, or easement, or part thereof, shown on a recorded plat;
WHEREAS, because the City is the sole owner of all property abutting the Barrack Street Vacation Area, no separate vacation agreement among abutting property owners is necessary;
WHEREAS, upon recordation, the Vacation Plat will vacate the Barrack Street Vacation Area and consolidate the vacated area with LRSNs 7000147 and 7000165 to create a single, contiguous parcel intended to be known as "LOT 12B", and to contain approximately 4.0257+/- acres or 175,360 +/- square feet, as shown on the Vacation Plat.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Hampton, Virginia, as follows:
1. That, pursuant to Section 2.05 of the Charter of the City of Hampton, Virginia, the vacation of that certain forty-four foot (44') wide unimproved portion of Barrack Street, containing approximately 0.3093+/- acres, or 13,474+/- square feet, as more particularly shown on the Vacation Plat attached hereto as Exhibit A, is hereby approved.
2. That the City Manager, or her authorized designee, is authorized to execute the Vacation Plat on behalf of the City, as the owner of all property abutting the Barrack Street Vacation Area, and to cause the executed and acknowledged Vacation Plat to be recorded in the Clerk's Office of the Circuit Court of the City of Hampton, Virginia. Upon recordation, the Vacation Plat shall effectuate the vacation of the Barrack Street Vacation Area and its consolidation with LRSNs 7000147 and 7000165 to create the parcel identified as "LOT 12B", containing approximately 4.0257+/- acres, or 175,360+/- square feet, as shown on the Vacation Plat.
3. That the City Manager, or her authorized designee, is authorized to execute such other documents and take such further actions as may be necessary or appropriate to carry out the purposes of this Ordinance, all in forms approved by the City Attorney.
4. That this Ordinance shall take effect immediately upon adoption.
