Discussion:

 

The Urban League of Hampton Roads, Inc. (the “Urban League”) is a Virginia nonstock corporation whose mission is to enable African Americans and others to secure economic self-reliance, parity and power and civil rights, and it implements its mission by providing services and programs in education, employment, health, and housing to Hampton Roads communities through direct services, advocacy, research, policy analysis, community mobilization, and collaboration throughout communities. The City has traditionally rented space at the Y.H. Thomas Community Center (the “Center”) to organizations of this nature, in furtherance of its dedication to providing positive community resources that benefit the local community and City as whole. The Center is located at 1300 Thomas Street (LRSN 8000281).

 

The attached use agreement is for a term of five years for the Urban League to utilize Room E as office and programming space. The rent to be charged is $1,455.00 per year (or $121.25 per month). The use agreement includes the City’s standard language regarding insurance, indemnification, and termination (including a termination for any reason with 90 days’ notice).

 

The Y.H. Thomas Community Center, Inc., a Virginia nonstock corporation who serves in an advisory and operational role to the City with respect to the Center, has reviewed and approved the use agreement.

 

City staff recommends approval of the Resolution.

 

This matter was properly advertised in accordance with Virginia §§ 15.2-1800 and 15.2-2100.

Conduct a public hearing and approve the Resolution to authorize the execution of the Use Agreement

 

Body

 

                     WHEREAS, the City is the owner of real property located at 1300 Thomas Street, identified as LRSN 8000281, more commonly referred to as the Y.H. Thomas Community Center (the “Property”);

 

                     WHEREAS, the Urban League of Hampton Roads, Inc. (the “Urban League”) desires to use Room E of the Property (the “Premises”) for office and programming space;

 

                     WHEREAS, the Y.H. Thomas Community Center, Inc., who serves in an advisory and operational role to the City with respect to the Center, reviewed and approved the Urban League’s continued use of the Premises;

 

                              WHEREAS, Parks, Recreation and Leisure Services staff determined it is in the best interest of the City and the community to allow the Urban League to use the Premises; and

 

                     WHEREAS, the Council has determined that the terms and conditions of a use agreement, substantially in the form attached hereto, are acceptable.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hampton, Virginia as follows:

 

                     1.                     That it approves a Use Agreement, in substantially the form attached hereto, between the City; the Y. H. Thomas Community Center, Inc.; and the Urban League of Hampton Roads, Inc. to utilize Room E on the Property; and

 

                     2.                     That the City Manager or her Authorized Designee is hereby authorized to execute and deliver to the Urban League of Hampton Roads, Inc. the Use Agreement in substantially the same form as attached hereto, subject to review and approval by the City Attorney.
