Resolution to Affirm the City of Hampton, Virginia’s Acceptance and Use of the Fiscal Year 2025 Virginia Juvenile Community Crime Control Act Plan Annual Contribution, in the amount of $315,704, through the Virginia Department of Juvenile Justice 

 

 

Purpose

PURPOSE/BACKGROUND:

The Commonwealth of Virginia’s Department of Juvenile Justice now requires localities to affirm, by separate resolution, the intended use of the Virginia Juvenile Community Crime Control Act (“VJCCCA”) annual contribution.  The annual contribution, this year in the amount of $315,704, was previously approved and appropriated to the Court Service Unit’s operating budget as part of the fiscal year 2025 budget adoption process finalized on May 8, 2024. 

 

 

Discussion:

The mission of the VJCCCA is "to deter crime by providing immediate, effective punishment that emphasizes accountability of the juvenile offender for his actions as well as reduce the pattern of repeat offending" (Code of Virginia, §16.1-309.2).  Funding is allocated to each locality through a formula based on a variety of factors including (1) the number and types of arrests in a locality; and (2) the average daily cost for serving the child.  To further ensure the continued commitment to youth, localities are also required to provide a local contribution, known as the “maintenance of effort” funding. 

 

Development of VJCCCA plans requires consultation with judges, Court Service Unit directors and Comprehensive Services Act Community Policy and Management Teams. There are no specific types of programs or services required in a plan. The intent is for programs and services to be developed that fit the unique needs of each respective locality.

 

Impact:

There is no impact to the Fiscal Year 2025 Council Approved Budget as the VJCCCA annual contribution, in the amount of $315,704, was previously approved and appropriated to the Court Service Unit’s operating budget on May 8, 2024.

                     WHEREAS, the City of Hampton, Virginia receives an annual contribution from the Virginia Juvenile Community Crime Control Act (“VJCCCA”) Plan through the Virginia Department of Juvenile Justice, in the amount of $315,704, with a required local contribution; and

 

                     WHEREAS, the annual contribution, this year in the amount of $315,704, was approved and appropriated on May 8, 2024 to the Court Service Unit’s operating budget as part of the budget adoption process for fiscal year 2025 (July 1, 2024 to June 30, 2025).

 

                     NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hampton, Virginia accepts and affirms the use of the Fiscal Year 2025 Virginia Juvenile Community Crime Control Act (“VJCCCA”) Plan annual contribution in the amount of $315,704 through the Virginia Department of Juvenile Justice; and, on May 8, 2024 said funding was approved and appropriated to the Court Service Unit’s operating budget as part of the annual budget adoption process for Fiscal Year 2025 (July 1, 2024 to June 30, 2025), to be used by the Court Service Unit in accordance with the terms and conditions of the statue.

 

                     BE IT FURTHER RESOLVED that the City Council authorizes the City Manager, or her designee, to execute any applicable agreement, subject to the approval of the City Attorney, and take any and all other actions necessary to satisfy the Virginia Department of Juvenile Justice’s documentation requirements.
