Resolution to Amend the Fiscal Year 2024 Council Approved Budget to Accept and Appropriate $152,988 in Additional Congestion Mitigation and Air Quality Funding from the Virginia Department of Transportation to the Capital Fund (Capital Projects Fund) for the Cunningham Drive Sidewalk Project
Purpose
The Cunningham Drive Sidewalk Project (UPC 102866) (the “Project”) includes construction of a sidewalk on the south side of Cunningham Drive from Sloop Court to the I-64 Overpass and widening of the existing sidewalk on the overpass. The City of Hampton requested a Transportation Improvement Program (“TIP”) amendment be approved by the Hampton Roads Transportation Planning Organization (“HRTPO”) to add reserve account funds of $152,988 to the Project; and HRTPO approved that addition at its November 16, 2023 meeting.

WHEREAS, in accordance with Virginia Department of Transportation ("VDOT") project allocation procedures, City Council must request, by resolution, that VDOT appropriate funds to highway projects in the City of Hampton;
WHEREAS, VDOT, the Hampton Roads Transportation Planning Organization (“HRTPO”) approved, at its meeting on November 16, 2023, a transfer to the City the sum of $152,988 in HRTPO Congestion Mitigation and Air Quality (“CMAQ”) Reserve Account for the Cunningham Drive Sidewalk Project (UPC 102866);
WHEREAS, these funds were not previously included in the Fiscal Year 2024 Council Approved Budget; and
WHEREAS, VDOT will pay those funds to the City on a reimbursement basis following the expenditure of City funds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON that it amends the Fiscal Year 2024 Council Approved Budget and hereby agrees to accept from VDOT $152,988 in CMAQ Reserve Account and appropriates those funds to the Capital Fund (Capital Projects Fund) for the Cunningham Drive Sidewalk Project; and
BE IT FURTHER RESOLVED that the City Manager, or her authorized designee, is hereby authorized to take any and all necessary actions to carry out the purposes of this Resolution, subject to the approval by the City Attorney.
