Resolution Directing the Chief Procurement Officer to Dispose of Certain Electronic Equipment via Donation to a Qualifying Charitable Corporation
Purpose
PURPOSE/BACKGROUND:
Virginia Code § 2.2-4343(A)(10) authorizes localities to adopt alternative procurement procedures by ordinance. Hampton City Code § 2-338 enables City Council to direct the Chief Procurement Officer to dispose of surplus personal property in a specified manner. The City owns surplus computers and related equipment which are obsolete or unusable, and have little value in the current market. PCs for People is a Minnesota nonstock corporation and 501(c)(3) which refurbishes computers and related electronic equipment for distribution to low-income families from its regional office located at 1933 E. Pembroke Avenue, Hampton, Virginia. The donation of the surplus personal property to the nonstock corporation is permitted pursuant to the Virginia Code and Hampton City Code sections noted above.
Impact:
No fiscal impact, the surplus equipment is obsolete and unusable, and has little value in the current market.

WHEREAS, the City of Hampton owns surplus computers and related electronic equipment which are obsolete or unusable, and have little value in the current market for such equipment;
WHEREAS, The City Council, pursuant to Hampton City Code Section 2-338, may direct the Chief Procurement Officer to dispose of surplus personal property in a specified manner;
WHEREAS, PCs for People is a Minnesota nonstock corporation and 501(c)(3) which refurbishes computers and related electronic equipment for distribution to low-income families from its regional office at 1933 E. Pembroke Avenue, Hampton, Virginia; and,
WHEREAS, the donation of such surplus property to the nonstock corporation is permitted under the Virginia Procurement Act pursuant to Virginia Code Section 2.2-4343(A)(10), which authorizes localities to adopt alternative procurement procedures by ordinance.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Hampton, Virginia:
1. That the Chief Procurement Officer, in consultation with the Chief Information Officer, is authorized and directed to determine which of the City’s computers and related electronic equipment are obsolete or unusable and of little value in the current market;
2. That the Chief Procurement Officer is further authorized to donate such computers and related electronic equipment to PCs for People, a Minnesota stock corporation authorized to do business in the Commonwealth of Virginia; and
3. That the City Manager or her designee is authorized to execute an agreement with PCs for People on behalf of the City to govern such donations in substantially the same form as the “Electronics Recycling Memorandum of Understanding” attached hereto as Exhibit A. Such agreement shall be subject to the approval of the City Attorney or her designee, and shall be for an initial term of not more than one year, with an option to renew for successive one-year terms in the City’s discretion.
