Consider Appeal of Revocation of the Zoning Administrator Permit (ZAP) Issued to James Jordan for a Short-Term Rental (STR), Located at 317 Woodside Drive [LRSN: 1200089] Due to Violations of Conditions contained in the ZAP

 

Purpose

Background Statement:

In accordance with Section 3-3(29) of the Hampton Zoning Ordinance, Zoning Administrator Permit No. 2024-0271 was issued on April 1, 2025 for a short-term rental, located at 317 Woodside Drive.  Since then multiple violations of the approved operational conditions have been documented.

 

The Zoning Administrator Permit (ZAP) was issued, subject to 22 conditions based upon the short-term rentals operational characteristics. Highlighted conditions include maximum daytime and overnight occupancy during limited hours, prohibition on events, and compliance with the City's noise ordinance.  The City has information demonstrating that multiple violations of the ZAP have occurred in the following areas:  overnight occupancy, daytime occupancy, prohibited events, and the noise ordinance. Based on the documented incidents and repeated violations of the approved operational conditions, the Zoning Administrator determined the short-term rental was operating outside the conditions and the ZAP was revoked on April 21, 2026.

 

Subsequently, the permittee has submitted an appeal to the Zoning Administrator's decision to revoke the ZAP. Pursuant to Section 3-3 (29)(d) of the Zoning Ordinance, a permittee aggrieved by the decision of the Zoning Administrator to revoke their ZAP shall appeal that decision to City Council.

 

Based upon the multiple violations of the permit conditions as outlined above as well as the public safety and welfare concerns associated with the recent activity at the short-term rental, staff recommends City Council uphold the approve the Zoning Administrator's decision to revoke the short-term rental ZAP.
