Resolution to Approve the Second Addendum to the Agreement for Construction and Relocation of Bridge Street Vent and Rehabilitation of Bridge Street Siphons Between the Hampton Roads Sanitation District and the City of Hampton, Virginia; (ii) Authorize the City Manager or Her Designee to Execute the Same; and to (iii) Appropriate the Sum of $30,835.10 to be Received by the City to the Miscellaneous Revenue Account of the Capital Project Funds
Purpose
PURPOSE/BACKGROUND:
The City constructed the replacement bridge on Bridge Street as part of the Capital Improvement Project, City Project No. 07-010, VDOT Project No. 000-114-199, UPC 93081 (the “Project”). Hampton Roads Sanitation District’s (“HRSD”) air vent pipe, wastewater siphons, and all connections, manholes, and related appurtenances (the “Facilities”) are located in whole or in part within the right-of-way of the bridge. The Project created a conflict with existing Facilities, requiring temporary relocation of part of those Facilities and permanent relocation and permanent improvements to other parts of those Facilities. HRSD and the City agree it is in the best interest of both entities to include the Facilities work in the Project and to share the associated costs. The base agreement was entered into on May 11, 2016, and a first amendment to that Agreement was approved last December. The portion of the Project outlined in this Second Addendum provides for the addition of certain joints and revisions to the storm drainage system and structure. The estimated total cost associated with this Second Addendum is $38,355.36, with the City bearing $7,520.27 ("City's Share") of this amount, and HRSD the remaining balance of $30,835.10 ("HRSD's Share"). Staff believes the terms of the foregoing cost share arrangement are fair and reasonable and requests approval of the Second Addendum and appropriation of the City's Share, as well as HRSD's Share when it is received.

WHEREAS, the City of Hampton, Virginia (the "City") has constructed a replacement bridge on Bridge Street as part of Capital Improvement Project # 07-010, VDOT Project #000-114-199, UPC: 93081 (the “Project”);
WHEREAS, pursuant to that certain Agreement for Construction and Relocation of Bridge Street Vent and Rehabilitation of Bridge Street Siphons dated May 16, 2016, and amended on or about December 13, 2017 (the "Agreement"), the City and the Hampton Roads Sanitation District (“HRSD”) agreed to HRSD's installation of air vent pipe, wastewater siphons, and all connections, manholes, and related appurtenances thereto (the “Facilities”) located in whole or in part within the right-of-way of Bridge Street;
WHEREAS, the Project creates a conflict with existing Facilities, which necessitated temporary relocation of part of the Facilities and permanent relocation and permanent improvements of other parts of those Facilities;
WHEREAS, HRSD and the City agree it is in their best interest to have the relocation and/or construction of the Facilities included into the Project, as well as to share the costs associated with that construction;
WHEREAS, additions and certain revisions are necessary to continue the project, as set forth in the attached Addendum #2 to the Agreement (the "Second Amendment"); and
WHEREAS, pursuant to the Second Amendment the total cost of those additions and revisions is $38,355.36; $30,835.10 of which shall be paid to the City by HRSD, and $7,520.27 of which was previously budgeted and appropriated to this Project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA, that the Fiscal Year 2019 City Council Approved Budget shall be amended to accept and appropriate $30,835.10 that has or will be received from HRSD pursuant to the Second Amendment to the Capital Projects Fund for improvements to the Bridge Street Bridge Replacement Over Salter’s Creek; and
BE IT FURTHER RESOLVED that the City Council authorizes the City Manager or her authorized designee to execute the Second Amendment and any additional contracts or agreements relating to that amend or the Project that may be necessary to implement the purposes of this resolution.
