Resolution Determining Kart-Man to be the Only Source Practicably Available From Which to Procure Replacement Parts for the Versa-Kart Toters Formerly Manfactured by Ameri-Kart and Authorizing the Negotiation and Execution of a Purchase Contract with Kart-Man as "Sole Source"
Purpose
PURPOSE/BACKGROUND:
Since 2001, Public Works Solid Waste division held a Sole Source agreement with Ameri-Kart for the production of Versa-Kart refuse and recycling containers. In July 2016, Ameri-Kart informed the City they have discontinued the manufacturing of rotational molded carts (which included the Versa-Kart). After stopping production they sold all inventory for parts to repair Versa-Karts to the vendor, Kart-Man, from Cave Creek, Arizona. The majority of our solid waste customers still have either the Versa-Karts refuse or recycling containers; which would calculate to approximately 74,000 containers. Occasionally, the Versa-Karts require repair or replacement parts such as wheels, bars, lids, and plugs replaced.
Discussion:
Public Works Solid Waste has procured a contract with Mid-Atlantic Waste Systems to purchase Schaffer style refuse and recycling containers for new customers or replacements as needed.
Impact:
If we are unable to make minor repairs when needed to Versa-Kart containers, new containers would need to be issued at City’s expense at a cost of $3.4 million with the current replacement containers.

WHEREAS, the City of Hampton’s Public Works Solid Waste picks up household waste, yard waste, scrap metals and bulky items from residences weekly within the City of Hampton;
WHEREAS, the City of Hampton’s Public Works Solid Waste serves approximately 41,200 solid waste customers per week;
WHEREAS, the City of Hampton’s Public Works Solid Waste held a Sole Source agreement with Ameri-Kart for the manufacturing of Versa-Kart refuse and recycling containers;
WHEREAS, the City of Hampton’s Public Works Solid Waste was informed by Ameri-Kart they have discontinued the rotational molded cart line, including the Versa-Kart containers which Hampton Solid Waste customers used;
WHEREAS, the City of Hampton’s Public Works Solid Waste was notified by sole source vendor Ameri-Kart that all Versa-Kart container replacement parts have been sold to Kart-Man, as exclusive dealer for all Ameri-Kart parts;
WHEREAS, the Hampton Solid Waste customers who still have Versa-Kart containers in operation are approximately 74,000 containers;
WHEREAS, the City of Hampton’s Public Works Solid Waste strives to provide the residents of Hampton with exceptional response to repairing refuse and recycling containers; and
WHEREAS, the City of Hampton’s Public Works Solid Waste only available source from which to obtain Versa-Kart replacement parts be from Kart-Man;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:
1. That the contract for procuring Versa-Kart replacement parts as described above may be negotiated and awarded to Kart-Man as a “sole source” without competitive sealed bidding or competitive negation as set forth in Virginia Code Section 2.2-4303.E;
2. That the City Manager or her authorized designee is hereby authorized to negotiate and execute a purchase contract with Kart-Man; and
3. That the notice awarding the contract to Kart-Man shall be posted in a public place pursuant to Virginia Code Section 2.2-4303.E
