Resolution Authorizing the Grant of an Encroachment, Pursuant to § 34-86 of the City Code, to Cellco Partnership d/b/a Verizon Wireless of Three Aerial Areas Comprising a Total of 8 Cubic Feet, More or Less, to Install an Antenna, a Utility Meter, and an Equipment Cabinet on a Dominion Energy (formerly Dominion Virginia Power) Pole in the Public Right-of-Way of Enfield Drive

 

Purpose

Purpose/Background:

Cellco Partnership, doing business as Verizon Wireless (“Licensee”), is requesting to encroach into three aerial areas to collocate on the Dominion Energy (formerly Dominion Virginia Power) pole located on the public right-of-way of Enfield Drive to install a 1.88 cubic feet antenna, remote radio heads totaling 2.37 cubic feet, diplexers totaling 0.23 cubic feet, a 0.39 cubic foot utility meter, a 0.23 cubic feet panel, and a 2.9 cubic feet equipment cabinet, totaling 8 cubic feet, more or less (“Licensed Improvements”) as illustrated on Exhibit “A” attached to the Encroachment Agreement.  Licensee demonstrated its authority to collocate on the Dominion Energy pole.

 

The request was routed to staff and local utility companies. While none have any objection, staff recommends a condition be placed on the approval that the applicant coordinate with the City’s Information Technology Department to submit an intermodulation study to verify that the Licensed Improvements will not interfere with the City’s existing towers.  Therefore, pursuant to § 34-86 of the City Code, staff recommends approval under the conditions outlined in the Encroachment Agreement.

WHEREAS, Cellco Partnership, doing business as Verizon Wireless (“Licensee”), is requesting to encroach into three aerial areas to collocate on the Dominion Energy (formerly Dominion Virginia Power) pole located in the public right-of-way of Enfield Drive to install a 1.88 cubic feet antenna, remote radio heads totaling 2.37 cubic feet, diplexers totaling 0.23 cubic feet, a 0.39 cubic foot utility meter, a 0.23 cubic feet panel, and a 2.9 cubic feet equipment cabinet, totaling 8 cubic feet, more or less (“Licensed Improvements”) as illustrated on Exhibit “A” attached to the Encroachment Agreement;

 

WHEREAS, Licensee demonstrated its authority to collocate on the Dominion Energy pole;

 

WHEREAS, the request was routed to staff and local utility companies, and staff recommends approval upon certain conditions, including that Licensee coordinate with the City’s Information Technology Department to submit an intermodulation study to verify that the Licensed Improvements will not interfere with the City’s existing towers; and

 

WHEREAS, pursuant to § 34-86 of the City Code, the City agrees to grant Cellco Partnership, doing business as Verizon Wireless a revocable license for the proposed encroachment under the terms and conditions as specified in the Encroachment Agreement.

 

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1.                      That the Encroachment Agreement between the City of Hampton and Cellco Partnership, doing business as Verizon Wireless is hereby approved; and 

 

2.                      That the City Manager, or her authorized designee, and Clerk of Council are hereby authorized to execute and attest the Encroachment Agreement, as set forth in this Resolution.
