Purpose

PURPOSE/BACKGROUND:

 

The City has a 15’ drainage easement along the rear of properties on the south side of Grays Landing (the “Property”).  Edith White (“Licensee”) owns the property located at 121 Grays Landing (LRSN 4004063) (“Licensee’s Parcel”). Licensee purchased Licensee’s Parcel in 2001 containing a shed comprising 112 square feet, more or less, and three sections of fence comprising a total of 50 square feet, more or less, on the Property.  The shed was damaged during a storm event in the summer of 2017 to the extent that it proved to be more cost effective to replace, rather than repair, the structure.  Licensee desires to replace the shed on the existing concrete pad and wishes to formalize the encroachments in the Licensed Area, comprising a combined area totaling 162 square feet, more or less, as illustrated on Exhibit “A” attached to the Encroachment Agreement.

 

The request was routed to staff and local utility companies, and none have any objection.  Therefore, pursuant to § 34-86 of the City Code, staff recommends approval under the conditions outlined in the accompanying Encroachment Agreement.

WHEREAS, the City has a 15’ drainage easement along the rear of properties on the south side of Grays Landing (the “Property”);

 

WHEREAS, Edith White (“Licensee”) owns the property located at 121 Grays Landing (LRSN 4004063) (“Licensee’s Parcel”);

 

WHEREAS, Licensee purchased Licensee’s Parcel in 2001 containing a shed comprising 112 square feet, more or less, and three sections of fence comprising a total of 50 square feet, more or less, on the Property;

 

WHEREAS,  the shed was damaged during a storm event in the summer of 2017 to the extent that it proved to be more cost effective to replace, rather than repair, the structure;

 

WHEREAS, Licensee desires to replace the shed on the existing concrete pad and wishes to formalize the encroachments in the Licensed Area, comprising a combined area totaling 162 square feet, more or less, as illustrated on Exhibit “A” attached to the Encroachment Agreement;

 

WHEREAS, staff recommends approval upon certain conditions; and

 

WHEREAS, pursuant to § 34-86 of the City Code, the City agrees to grant Edith White a revocable license for the proposed encroachment under certain terms and conditions as specified in the attached Encroachment Agreement.

 

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1. That the Encroachment Agreement between the City of Hampton and Edith White is hereby approved; and 

 

2. That the City Manager, or her authorized designee, and Clerk of Council are hereby authorized to execute and attest the Encroachment Agreement, as set forth in this Resolution.
