Purpose

PURPOSE/BACKGROUND:

The City Council adopted a resolution wherein the Hampton Redevelopment and Housing Authority (HRHA) was designated as the agency to implement the City’s Comprehensive plan as it relates to residential development and redevelopment with a residential component. In the past and consistent with this policy, the City conveyed several sites to the HRHA.

 

The City now desires to transfer the five parcels to the HRHA for redevelopment in accordance with the City’s Comprehensive Plan.

 

To that end, the City staff recommends the transfer of the lots to the HRHA subject to the conditions that the HRHA: (i) continue to market the five sites for redevelopment; (ii) consult with the City before any unsolicited proposal for the lots is accepted, or an RFP or RFQ is issued or the lots are sold, and (iii) pay over to the City the net proceeds from the sale of the lots without further notice or demand.

 

Discussion:

 

This conforms with the City's policy regarding development.

                     WHEREAS, the City of Hampton (“City”) owns five vacant parcels of land in the Buckroe area of the City of Hampton, Virginia: 1) 1801 N. Mallory Street, .28 ac±, LRSN: 12006347; 2) 1805 N. Mallory Street, .26 ac±, LRSN:  12006348; 3) 226 Atlantic Avenue, .28 ac±, LRSN:  12006306; 4) 229 Herbert Avenue, .15 ac±, LRSN:  12006329; and 5) 1706 N. Mallory Street, .82 ac±, LRSN:  12006305 (collectively, “the Buckroe Lots”);

                     WHEREAS, the City Council has designated the Hampton Redevelopment and Housing Authority (“HRHA”) as the agency to implement the City’s Comprehensive Plan as it relates to residential development and redevelopment with a residential component; and                     

                     WHEREAS, to that end, the City desires to transfer title to the Buckroe Lots to the HRHA for redevelopment in accordance with the City’s Comprehensive Plan and the additional conditions that the HRHA: (i) continue to market the sites for redevelopment; (ii) consult with the City before any unsolicited proposal for the lots is accepted, or an RFP or RFQ is issued or the lots are sold, and (iii) pay over to the City the net proceeds from the sale of the lots without further notice or demand.

                     NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

                     1.                     That it approves the transfer to the HRHA of the Buckroe Lots, 1801 N. Mallory Street, .28 ac±, LRSN: 12006347; 2) 1805 N. Mallory Street, .26 ac±, LRSN:  12006348; 3) 226 Atlantic Avenue, .28 ac±, LRSN:  12006306; 4) 229 Herbert Avenue, .15 ac±, LRSN:  12006329; and 5) 1706 N. Mallory Street, .82 ac±, LRSN:  12006305, located in the City of Hampton in the Buckroe area for redevelopment in accordance with the City’s Comprehensive Plan and the additional conditions that the HRHA: (i) continue to market the Buckroe Lots for redevelopment; (ii) consult with the City before any unsolicited proposal for the lots is accepted, or an RFP or RFQ is issued or the lots are sold,  and (iii) pay over to the City the net proceeds from the sale of the lots without further notice or demand;

                     2.                     That the City Manager or her authorized designee and the Clerk be and are authorized to execute and deliver to the HRHA any and all necessary legal documents to effectuate the transfer; such documents shall include, but not be limited to, contracts, deeds, releases for sale, transfer, and conveyance of the parcels generally described above in the Buckroe area of the City of Hampton, Virginia; and

                     3.                     That a copy of this Resolution be attached to the deed of conveyance of the above described parcels.
