Resolution Affirming Commitment to Fund the Locality Share of Two Revenue Share Projects Under Agreements with the Virginia Department of Transportation and Provide Signature Authority
Purpose
PURPOSE/BACKGROUND:
The City of Hampton (the “City”) has been operating under Programmatic Project Administration Agreements (“PPAA”) with the Virginia Department of Transportation (“VDOT”) as part of the Revenue Sharing program since 2016. Beginning June 30, 2022, VDOT will no longer allow PPAAs and will now require individual Project Administration Agreements (“PAA”) for each funded project. Revenue Share Funding is typically funded 50% by the Commonwealth of Virginia and 50% by the Locality requesting the project. The PPAAs had terms of three fiscal years with the allowance of extensions for an additional term of three fiscal years. The PAAs generally do not expire and are good for the life of the project.
City Council has previously approved resolutions of support for the Grant Street New Roadway Project (UPC 117115) and Pembroke Avenue 3A Reconstruction Project (UPC 110008). The resolutions no longer meet the requirements from VDOT and need to be updated to allow these two projects to proceed with reimbursement from VDOT. The Grant Street New Roadway Project (UPC 117115) will provide economic development opportunities to Downtown Hampton and provide a means of secondary ingress and egress from the Mary Jackson Community Center when it is completed. The Pembroke Avenue 3A Reconstruction Project (UPC 110008) will repave and install new lane markings to continue the road diet, convert the existing four lane section to three vehicular lanes and add two new bike lanes from West Skyland Drive to Grimes Road intersection. Further, the Grimes Road intersection will be improved with an upgraded vehicle detection system and new decorative sidewalks.

WHEREAS, the City of Hampton (the “City”) is a recipient of Virginia Department of Transportation (“VDOT”) funds under various grant programs for transportation-related projects;
WHEREAS, VDOT requires each locality, by resolution, to provide assurance of its commitment to funding its local share; and
WHEREAS, VDOT no longer accepts Programmatic Project Administration Agreements and the will now require individual Project Administration Agreements for two existing City projects: the Grant Street New Roadway Project (UPC 117115) and the Pembroke Avenue 3A Reconstruction Project (UPC 110008) (collectively the “Projects”).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, VIRGINIA, that for the purposes of the Projects [the Grant Street New Roadway (UPC 117115) and the Pembroke Avenue 3A Reconstruction (UPC 110008)], the City hereby commits to fund its local share of preliminary engineering, right-of-way, and construction (as applicable) for the Projects under agreement with VDOT and in accordance with the project financial documents; and
BE IT FURTHER RESOLVED, that the City Council authorizes the City Manager, or her authorized designee, to execute all agreements and/or addendums for any approved projects with VDOT and to take any and all actions necessary to carry out the purposes of this Resolution, subject to approval by the City Attorney.
