Resolution Determining Mid-Atlantic Waste Systems to be the Only Source Practicably Available from which to Procure Equipment, Parts, and Service for All Automated Solid Waste Collection Vehicles and Authorizing the Negotiation and Execution of a Purchase Contract with Mid-Atlantic as a “Sole Source”
Purpose
PURPOSE/BACKGROUND:
The Department of Public Works, Solid Waste Division, strives to provide the residents of Hampton with exceptional responses to their waste removal needs by maintaining state-of-the art automated solid waste collection vehicles. THC Enterprises, Inc., trading as Mid-Atlantic Waste Systems, is the only vendor in the Commonwealth of Virginia approved to service all Solid Waste Division equipment.
The City recognizes the public interest in providing the most efficient means reasonably available and affordable to maintain equipment in the Solid Waste Division. The price at which Mid-Atlantic Waste Systems has offered the equipment, parts, and service has been determined to be fair and reasonable. The Manager of Consolidated Procurement approves this sole source procurement.

WHEREAS, the Department of Public Works, Solid Waste Division, strives to provide the residents of Hampton with exceptional responses to their waste removal needs by maintaining state-of-the art automated solid waste collection vehicles;
WHEREAS, THC Enterprises, Inc., trading as Mid-Atlantic Waste Systems, is the only vendor in the Commonwealth of Virginia approved to service all Solid Waste Division equipment;
WHEREAS, the City recognizes the public interest in providing the most efficient means reasonably available and affordable to maintain equipment in the Solid Waste Division; and
WHEREAS, the price at which Mid-Atlantic Waste Systems has offered the equipment, parts, and service has been determined to be fair and reasonable.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:
1. That the Resolution determining Mid-Atlantic Waste Systems to be the only source practically available from which to procure equipment, parts, and services for all automated solid waste collection vehicles is approved;
2. That the contract for procuring goods and services described herein may be negotiated and awarded to Mid-Atlantic Waste Systems as a “sole source” without competitive sealed bidding or competitive negotiation as set forth in Virginia Code Section 2.2-4303(E);
3. That the City Manager or her authorized designee is hereby authorized to negotiate and execute a purchase contract with Mid-Atlantic Waste Systems; and
4. That the notice awarding the contract to Mid-Atlantic Waste Systems shall be posted in a public place pursuant to Virginia Code Section 2.2-4303(E).
