Purpose

Background Statement:

Use Permit Application No. 24-0468 is a request to operate a short-term rental (STR) at 1536 Morgan Dr [LRSN: 12003152]. The property is currently zoned One-Family Residential (R-9) District which allows for the desired use, subject to an approved use permit. The property is also situated in the Long Creek 1 Zone of the Short-term Rental Overlay (O-STR) District.

 

The Hampton Community Plan (2006, as amended) calls for evaluating land use proposals from a regional, city-wide and neighborhood perspective. Furthermore, land-use and economic development policies related to this land use application include safeguarding the integrity of existing residential neighborhoods, encouraging a mix of land uses that is appropriate and promotes the efficient use of land, and expanding tourism, entertainment, and cultural opportunities within the city.

 

The application meets all conditions required for approval of a Zoning Administrator Permit, including the density cap and separation between STRs, except for not having the required parking on-site. The applicant proposes meeting the parking requirement of one (1) parking space, should the Use Permit be approved, by installing the required parking space. Similarly, one of staff’s recommended conditions would require the parking to be installed prior to operation. Otherwise, the operational conditions are in line with those required of administratively approved STRs.

 

At the Planning Commission meeting, one Commissioner spoke about the broader short-term rental policy adopted by the City of Hampton and not specifically to the merits of this particular application. Then during its deliberations, the Planning Commission debated whether properties capable of meeting the on-site parking requirement should be supported through the use permit process prior to installing the required parking. The majority of Commissioners were concerned that the use permit approval would not compel the applicant to install the necessary parking immediately and that an applicant could ultimately hold a spot for up to two years without making the required improvements and operating.
