Resolution Determining Siemens to be the Only Source Practicably Available from which to Procure Heating, Ventilation, and Air Conditioning Controls and Services and Authorizing the Negotiation and Execution of a Purchase Contract with Siemens as a “Sole Source”
Purpose
PURPOSE/BACKGROUND:
The Facilities Division of the Department of Public Works maintains a number of public buildings that have heating, ventilation, and air conditioning controls manufactured by Siemens. Siemens is the only vendor authorized to supply equipment, service, and warranties on Siemens-manufactured heating, ventilation, and air conditioning controls;
The City recognizes the public interest in providing the most efficient means reasonably available and affordable to maintain equipment in all public buildings. The price at which Siemens has offered for its parts and service have been determined to be fair and reasonable. The Manager of Consolidated Procurement approves this sole source procurement.

WHEREAS, the Facilities Division of the Department of Public Works maintains a number of public buildings that have heating, ventilation, and air conditioning controls manufactured by Siemens;
WHEREAS, Siemens is the only vendor authorized to supply equipment, service, and warranties on Siemens-manufactured heating, ventilation, and air conditioning controls;
WHEREAS, the City recognizes the public interest in providing the most efficient means reasonably available and affordable to maintain equipment in all public buildings; and
WHEREAS, the price at which Siemens has offered for its parts and service have been determined to be fair and reasonable.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:
1. That the Resolution determining Siemens to be the only source practically available from which to procure parts and services for Siemens heating, ventilation, and air conditioning controls is approved;
2. That the contract for procuring goods and services described herein may be negotiated and awarded to Siemens as a “sole source” without competitive sealed bidding or competitive negotiation as set forth in Virginia Code Section 2.2-4303(E);
3. That the City Manager or her authorized designee is hereby authorized to negotiate and execute a purchase contract with Siemens; and
4. That the notice awarding the contract to Siemens shall be posted in a public place pursuant to Virginia Code Section 2.2-4303(E).
