Ordinance Accepting the Bid Submitted by Virginia Electric and Power Company, a Virginia Public Service Corporation, Doing Business in Virginia as Dominion Energy Virginia, for a Non-Exclusive Easement Agreement to Use and Occupy City-owned Property Located within the City for the Purposes Transmitting and Distributing Electric Power to Provide Electric Services to Property Located 187 Hall Road, Hampton, Virginia

 

...Purpose

PURPOSE/BACKGROUND:

The Owner of property located at 187 Hall Road, Hampton, Virginia, contacted the City of Hampton ("City") to inquire if the City would allow electric services to be run across certain City-owned property to serve his property.  The Constitution of Virginia and the Virginia Code give the City the authority to grant easements over City-owned property, but if the easement is for a period greater than five years, then the City must go through the bid process set forth in the Virginia Code.  Per the Owner’s request, the City agreed to offer a non-exclusive easement for the purpose of transmitting and distributing electric power across City-owned property to qualified provider(s) to provide electric services to the Owner’s property.  To comply with the Virginia Code, the City publicly invited bids for the non-exclusive easement, subject to the terms and conditions set forth in the City’s proposed Ordinance and the Agreement attached as “EXHIBIT 1” thereto.  The Public Notice for the invitation for bids for the easement was run in the newspaper as required by Virginia Code.  At the May 14, 2025 City Council Meeting, one bid from Virginia Electric and Power Company, a Virginia public service corporation, doing business in Virginia as Dominion Energy Virginia (“Dominion”) was received, accepted, and opened. 

 

City staff recommends accepting Dominion's bid and granting Dominion the non-exclusive easement as set forth in the aforesaid "EXHIBIT 1."  As required by the Virginia Code, a public hearing has been scheduled for the May 28, 2025 City Council Meeting.

Body

WHEREAS, on May 14, 2025, pursuant to the provisions of §15.2-2100 et. seq. of the Code of Virginia, 1950, as amended, the City offered an easement to qualified electric services providers to provide electric services to that certain property located at 187 Hall Road, Hampton, Virginia, by publicly inviting bids for a non-exclusive easement agreement, subject to the terms and conditions set forth in the Agreement attached hereto as “EXHIBIT 1” and made a part hereof to this Ordinance;

 

                     WHEREAS, Virginia Electric and Power Company, a Virginia public service corporation, doing business in Virginia as Dominion Energy Virginia (“Dominion”), was one of the highest, qualified, responsible bidders;

 

                     WHEREAS, the requirements of §15.2-2101 and §15.2-2102 of the Code of Virginia, 1950, as amended, having been met and after careful consideration of the bids submitted, the bid of Dominion should be accepted by City Council; and

 

                     WHEREAS, the City should grant the aforesaid electric services easement to Dominion subject to the execution of that certain Agreement in substantially the same form as attached hereto as “EXHIBIT 1” by the parties.

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia as follows:

 

1.                     That the bid of Dominion is hereby accepted; and

 

2.                     That the City Manager, or her authorized designee, is hereby authorized to execute the Agreement attached hereto as “EXHIBIT 1”, in substantially the same form as set forth in this Ordinance, and to take any and all actions necessary to carry out the purposes of this Ordinance, subject to approval by the City Attorney.
