Resolution Determining Q.Design, PLC to be the Only Source Practically Available From Which to Procure Engineering and Design Services for the Phase I Design of Renovations of War Memorial Stadium

 

 

Purpose

Purpose/Background:

 

Council has previously expressed a desire to invest in an upgrade of the War Memorial Stadium to address issues relating to the age of the facility.  The Peninsula Stadium Authority ("PSA") would like approval to proceed with the first phase of investment.  Q.Design, PLC ("Q Design") has offered its services for that purpose as it is extending and expanding on work that they have already performed for the PSA at a price that is fair and reasonable.

Impact:

 

$600,000.00 is currently available for the purpose of renovations to War Memorial Stadium.  The actual amount to be expended for the purposes of this contract is expected to be less, but the amount cannot be fully determined until negotiations regarding the scope of work are complete.

Body

                     WHEREAS, the Peninsula Stadium Authority (“PSA”) is a body politic and corporate of the Commonwealth established by Resolution of the City Council of the City of Hampton pursuant to the Public Recreational Facilities Authority Act (Code of Virginia §15.2-5600 et. seq.);

 

                      WHEREAS, the primary purpose of the PSA is the ownership and operation of War Memorial Stadium (“Stadium”) located at 1889 W. Pembroke Avenue, Hampton, Virginia;

 

                     WHEREAS, the Stadium was first opened in 1948 and is in need of substantial renovation;

 

                     WHEREAS, the PSA contracted and consulted with Q.Design, PLC (“Q Design”), a Virginia professional limited liability company located on Fort Monroe and engaged in the business of architecture, interiors, and planning, for preliminary conceptual design of the renovations;

 

                     WHEREAS, additional engineering and design work (“Additional Work”) is needed to facilitate the first phase of design and renovation of the Stadium;

 

                     WHEREAS, the Additional Work is an extension and expansion of the work already performed by Q Design for the PSA;

 

                     WHEREAS, pursuant to Code of Virginia §15.2-5605, the City of Hampton, as the PSA’s sole participating locality, may appropriate funds and enter into contracts for any purpose of the PSA, including, but not limited to, construction, development, and operation of the Stadium;

    

                     WHEREAS, the Hampton City Council determined the only practically available source from which to obtain the Additional Work is Q Design; and

 

                     WHEREAS, Q Design has offered its services for this purpose at a price which is fair and reasonable.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:

 

                     1.                     That the contract for procuring the continuation of engineering and design services for the War Memorial Stadium and the benefit of the Peninsula Stadium Authority described above may be negotiated and awarded to Q.Design, PLC as the “sole source” without competitive sealed bidding or competitive negotiation as set forth in Code of Virginia §2.2-4303(E);

 

                     2.                     That the City Manager or her authorized designee is hereby authorized to negotiate and execute a purchase contract with Q.Design, PLC; and

 

                     3.                     That the notice awarding the contract to Q.Design, PLC shall be posted in a public place pursuant to Code of Virginia §2.2-4303(E).
