Resolution to Endorse a Certain Transportation Alternatives Set Aside Program for the Old Buckroe Road Pedestrian Improvements Capital Project and North Mallory Street Bike and Pedestrian Improvements Capital Project

 

Purpose

PURPOSE/BACKGROUND:

The City of Hampton has identified two (2) projects that potentially qualify for VDOT’s consideration under the Transportation Alternatives Set-Aside program.  This program funds projects on a 20% Minimum Local Match and 80% Maximum Federal share basis but we are requesting a 21% Local and 79% Federal share to help the project application score of the project.  The two (2) projects are:

 

      1.                     Old Buckroe Road Pedestrian Improvements: This project will provide pedestrian improvements along Old Buckroe Road from Pembroke Avenue to Fox Hill Road for a total distance of 1.4 miles to include sidewalks, crosswalks, ADA compliant ramps, pedestrian crossing signals & lighting.

 

      2.                      North Mallory Street Bike & Pedestrian Improvements: This project is the reconstruction of Mallory Street from Mercury Boulevard to Shelton Street and will be a Road Diet to reduce the travel lanes from four (4) to two (2), add a two-way left-turn center lane and buffered bike lane in both directions, and ADA amenities to include lighting, pedestrian signal(s), sidewalks, and ramps as needed within the existing Right-of-Way (ROW) for a total distance of 1.0 miles. This project was identified in the City’s Bike Walk Hampton study, adopted by City Council on December 14, 2016.  See attached preliminary concept profile.

 

In accordance with Commonwealth Transportation Board construction allocation procedures, the City Council must endorse a request in order for that Board to establish such programs, which endorsement is also required for the Virginia Department of Transportation to program those projects into its Six-Year Improvement Plan.   

 

Discussion:

 

The North Mallory Street proposed bike and pedestrian improvement project is included in the recently adopted Bike Walk Hampton plan, adopted by City Council on December 14, 2016, and is directly adjacent to the Birthplace of America Trail alternative route that was adopted by the Hampton Roads Transportation Planning Organization on July 20, 2017.

The federal funds are paid on a reimbursement basis following City expenditure, to be allocated with the subsequent resolution following the execution of the project agreement.  The 21% Local match has been partially requested in the City’s FY21 Capital Improvement Plan (CIP) with the remaining to be requested in FY22.

 

Impact:

 

These projects improve bike and pedestrian access and safety in the Old Buckroe and Phoebus areas.

Body

                    

                     WHEREAS, in accordance with the Commonwealth Transportation Board (“CTB”) construction allocation procedures, it is necessary that a resolution be received from the sponsoring local jurisdiction or agency requesting the Virginia Department of Transportation (“VDOT”) to establish a project in the City of Hampton (the “City”);

 

                     WHEREAS, the City’s Department of Public Works plans to administer two (2) new highway projects eligible for the VDOT Transportation Alternatives program, including the Bike and Pedestrian Improvement Reconstruction project along North Mallory Street from Mercury Boulevard to Shelton Road and the Pedestrian Improvement Project along Old Buckroe Road from Pembroke Avenue to Fox Hill Road/Silver Isles Boulevard, in the City of Hampton (the “Projects”);

 

                     WHEREAS, VDOT further requires the City to execute a project administration agreement and other necessary agreements to implement the Projects and requires that City Council grant authority for the City Manager to execute project administration agreements and City/State Agreements for implementation of these projects; and

 

                     WHEREAS, the federal funds are reimbursable and are paid on a reimbursement basis following the expenditure of City funds.

 

                     NOW, THEREFORE, BE IT RESOLVED THAT THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA, hereby:

                     A. Requests that the the Commonwealth Transportation Board, to the extent that they have not already done so, establish projects to construct the following projects:

                      1. North Mallory Street Reconstruction from Mercury Boulevard to Shelton Road with a total estimate project cost of $960,000 and a 79% Federal Share of $758,400 and a 21% Local Share of $201,600.         

                       2. Old Buckroe Road Pedestrain Improvement from Pembroke Avenue to Fox Hill Road /Silver Isles Boulevard with a total estimate project cost of $1,050,251 and a 79% Federal Share of $829,698 and a 21% Local Share of $220,553;

                    B.  Agrees to enter into a project administration agreement with VDOT and provide the necessary oversight to ensure the Projects are developed in accordance with all applicable federal, state and local requirements for design, right-of-way acquisition, and construction of the project;

                      C. Agrees to provide a twenty-one percent (21%) matching contribution and its share of the total cost for preliminary engineering, right-of-way, construction, and future maintenance and operating for the upkeep of the completed Projects in accordance with the project financial documents subject to appropriation;

                      D.  Agrees that if all or part of the Projects  is cancelled,  to reimburse VDOT for the total amount of costs expended by VDOT through the date VDOT is notified of such cancellation and to repay any funds previously reimbursed that are later deemed ineligible by the Federal Highway Administration or VDOT; and

          E. Authorizes the City Manager or her authorized designee to apply for funds and execute the Project Administration Agreement documents and any subsequent contracts or agreements relating to the Projects, subject to approval by the City Attorney.
