Ordinance Approving the Vacation of a Portion of Right of Way at the Intersection of Rip Rap Road and Armistead Avenue, Comprising 5,254 Square Feet (0.1206 Acre), More or Less, to Patrick LLC pursuant  to Chapter 34, Article V of the Hampton City Code.

 

 

Purpose

PURPOSE/BACKGROUND:

Patrick, LLC (“Patrick”) owns the commercial property located at 539 N. Armistead Avenue (LRSN 2000754), and the City owns the right of way at the intersection of Rip Rap Road and N. Armistead Avenue.  Patrick requests the vacation of 5,254 square feet (0.1206 acre), more or less, at the intersection of Rip Rap Road and N. Armistead Avenue (the “Vacation Area”) because it is contemplating substantial property improvements, which align with the City’s discussions of commercial corridor redevelopment in this area; and Patrick’s improvements will increase the net value of its property, netting additional real estate taxes, and provide increased revenue through an upgraded, modern, and attractive facility, thus increasing sales taxes. 

 

Pursuant to Section 34-120 of the City Code, the City values the Vacation Area at Two Thousand Six Hundred Twenty-Seven and 00/100 Dollars ($2,627.00).  None of the local public utility companies object to this request, and staff does not find the Vacation Area will be needed for any other public purpose.  Based on the foregoing, staff recommends approval of this request for the purchase price of Two Thousand Six Hundred Twenty-Seven and 00/100 Dollars ($2,627.00) pursuant to Chapter 34, Article V of the Hampton City Code.

WHEREAS, Patrick, LLC (“Patrick”) owns the commercial property located at 539 N. Armistead Avenue (LRSN 2000754);

 

WHEREAS, the City owns the right of way at the intersection of Rip Rap Road and N. Armistead Avenue;

 

WHEREAS, Patrick requests the vacation of 5,254 square feet (0.1206 acre), more or less, at the intersection of Rip Rap Road and N. Armistead Avenue (the “Vacation Area”) because it is contemplating substantial property improvements, which align with the City’s discussions of commercial corridor redevelopment in this area; and Patrick’s improvements will increase the net value of its property, netting additional real estate taxes, and provide increased revenue through an upgraded, modern, and attractive facility, thus increasing sales taxes;

 

WHEREAS, pursuant to Section 34-120 of the City Code, the City values the Vacation Area at Two Thousand Six Hundred Twenty-Seven and 00/100 Dollars ($2,627.00);

 

WHEREAS, staff and none of the local public utility companies object to this request; therefore, staff recommends approval;

 

WHEREAS, the City, acting by and through its City Council, is of the opinion that the Vacation Area is not now and will not be needed for public interest; and

 

WHEREAS, pursuant  to Chapter 34, Article V, of the Hampton City Code, City Council agrees to vacate a portion of right of way at the intersection of Rip Rap Road and N. Armistead Avenue, comprising 5,254 square feet (0.1206 acre), more or less, for the purchase price of Two Thousand Six Hundred Twenty-Seven and 00/100 Dollars ($2,627.00).

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

 

1.                      That the vacation of a portion of right of way at the intersection of Rip Rap Road and N. Armistead Avenue, comprising 5,254 square feet (0.1206 acre), more or less, is approved; 

 

2.                      That the City Manager, or her authorized designee, and Clerk of Council are authorized to execute and attest the vacation of a portion of right of way at the intersection of Rip Rap Road and N. Armistead Avenue as set forth in this Ordinance; and

 

3.                     That a certified copy of this vacation ordinance shall be recorded in the Office of the Clerk of the Circuit Court for the City of Hampton, Virginia in the manner as deeds are recorded and indexed in the name of the City of Hampton.
