Resolution Accepting and Appropriating $70,234.70 to the Capital Projects Miscellaneous Revenue Account of the Capital Project Fund to be Received from the City of Newport News as a Reimbursement for Waterline Design Costs in the Queens Way Streetscape Project based on Agreement between the City of Newport News (Waterworks) and the City of Hampton

Purpose

The City of Hampton (“City”) is constructing streetscape improvements along East Queens Way (from Kings Way to Wine Street), East Queen Street (from Wine Street to Eaton Street) and South King Street (from Queens Way to Settlers Landing Road) as part of the ARPA-funded improvements in Downtown Hampton.  The City will be disturbing Queens Way starting in late Summer of 2024, and the City of Newport News Waterworks Department (“NNWW”) would like to take the opportunity to replace their aging waterline at the same time, to avoid impacting the City’s corridor improvements in the coming years.  NNWW has requested that the City employ the City’s consultant (Kimley-Horn and Associates, Inc.) working on the Queens Way improvements to handle the design of NNWW’s waterline.  The City of Newport News agrees, pursuant to that certain Cost Sharing Agreement Regarding Extension of Water Main, dated October 11, 2023 (“Agreement”), to pay and reimburse the City the full costs of the design of NNWW’s proposed waterline improvements.  A copy of the Agreement is attached hereto.

WHEREAS, the City of Hampton (“City”) is constructing streetscape improvements along East Queens Way (from Kings Way to Wine Street), East Queen Street (from Wine Street to Eaton Street) and South King Street (from Queens Way to Settlers Landing Road) as part of the ARPA-funded improvements in Downtown Hampton, known as the Queens Way Streetscape Project (the “Project”);

 

                     WHEREAS, the City will commence the Project in late Summer of 2024, and during that time, the City of Newport News Waterworks Department (“NNWW”) would like to take the opportunity to replace their aging waterline to avoid impacting the City’s corridor improvements in the coming years;

 

                     WHEREAS, NNWW has requested that the City employ the City’s consultant (Kimley-Horn and Associates, Inc.) working on the Queens Way improvements to handle the design of NNWW’s waterline;

 

                     WHEREAS, the City of Newport News agrees to pay and reimburse the City the full costs of the design of NNWW’s proposed waterline improvements totaling $70,234.70, pursuant to that certain Cost Sharing Agreement Regarding Extension of Water Main, dated October 11, 2023 (“Agreement”), a copy of which is attached hereto; and

                  

   WHEREAS, City Council needs to accept and appropriate the $70,234.70 to be received from the City of Newport News as a reimbursement. 

 

                    

                     NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:

 

                     1.                     That the City Council of the City of Hampton, Virginia hereby accepts and appropriates $70,234.70, and any supplement funding that may be required, to the Capital Projects Miscellaneous Revenue Account of the Capital Project Fund to be received from the City of Newport News as reimbursement to the City of Hampton pursuant to the Agreement for the design costs of NNWW’s waterlines to be installed in the Queens Way Streetscape Project; and

 

                     2.                     That the City Council authorizes the City Manager or her authorized designee to execute any additional contracts, agreements, or documents relating to the Project, so long as the documents contain such terms, conditions, and modifications as may be acceptable to the City Manager and in a form deemed satisfactory to the City Attorney.
