Title

Resolution to Request the Virginia Department of Transportation to Program Eight State of Good Repair Projects into its Six-Year Improvement Plan; to Amend the City Manager's Council Approved FY2025 Capital Fund (Capital Projects Fund) Budget to Incorporate each of those Projects; to Appropriate $3,100,522 of Available VDOT State of Good Repair Funds to the Capital Projects Fund for each of those Projects; and to Authorize the City Manager or Her Designee to Execute any Necessary Agreements

 

Purpose

The Commonwealth Transportation Board approved, by Resolution on June 18, 2024, the State of Good Repair district funding distribution percentages for fiscal year 2025. Pursuant to Code of Virginia § 33.2-369, as amended, titled “State of Good Repair”, the Virginia Department of Transportation (“VDOT”) provides funding for reconstruction and replacement of structurally deficient state and locally owned bridges and rehabilitation of pavement, including municipality maintained primary extensions. The City of Hampton (“City”) applied and was approved for that State of Good Repair funding, and a total of $1,499,253 was allocated for four (4) projects, as follows: 671 Pembroke Avenue Resurfacing Project ($356,307); 672 Pembroke Avenue Resurfacing Project ($335,327); 695 Pembroke Avenue Resurfacing Project ($370,260); 661 Pembroke Avenue Resurfacing Project ($437,359).

 

In addition, in May of 2024, VDOT identified an available balance in the Hampton Roads State of Good Repair balance entry account and offered localities an opportunity to apply for additional funding.  The City applied and was approved for additional State of Good Repair funding in a total amount of $1,601,269 to be allocated for four (4) additional projects, as follows: 663 Pembroke Avenue Resurfacing Project ($547,735); 664 Pembroke Avenue Resurfacing Project ($582,557); 665 Pembroke Avenue Resurfacing Project ($243,725); and 666 Pembroke Avenue Resurfacing Project ($227,252). 

 

All of these projects will enhance transportation within the City of Hampton. Once the allocations are accepted by the City, the funds are available immediately. VDOT has already assigned project numbers in anticipation of the City's approval of this request.

                      WHEREAS, in accordance with the Virginia Department of Transportation (“VDOT”) project funding allocation procedures, the City Council, by resolution, must request VDOT program highway projects in the City of Hampton (“City”);

 

WHEREAS, VDOT indicated it is prepared to immediately allocate $3,100,522 of State of Good Repair funds to be used by the City for eight (8) resurfacing projects and has assigned UPC numbers to those projects in anticipation of the City’s request;

 

WHEREAS, those projects and associated amounts include:  (1) 671 Pembroke Avenue Resurfacing Project, UPC 125495 ($356,307);  (2) 672 Pembroke Avenue Resurfacing Project, UPC 125497 ($335,327); (3) 695 Pembroke Avenue Resurfacing Project, UPC 125503 ($370,260); (4) 661 Pembroke Avenue Resurfacing Project, UPC 125505 ($437,359); (5) 663 Pembroke Avenue Resurfacing Project, UPC 126105 ($547,735); (6) 664 Pembroke Avenue Resurfacing Project, UPC 126111 ($582,557); (7) 665 Pembroke Avenue Resurfacing Project, UPC 126112 ($243,725); and (8) 666 Pembroke Avenue Resurfacing Project, UPC 126114 ($227,252) (collectively referred to as the "Projects");

 

                                          WHEREAS, state funds have previously been allocated for this effort at 100% of cost and are available for disbursement to the City;

 

                     WHEREAS, project administration agreements with VDOT are necessary for securing VDOT commitment on those funds for the Projects; and

 

WHEREAS, the Projects were not previously included in the Capital Fund (Capital Projects) Fund of the City Manager's, City Council approved budget for fiscal year 2025 ("FY2025 Capital Budget").

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, VIRGINIA for the purposes of the Projects that:

 

1.  The Virginia Department of Transportation is requested to program the following eight (8) projects into its Six-Year Improvement plan, and allocate $3,100,522 of State of Good Repair funds as follows: 

 

a)                     671 Pembroke Avenue Resurfacing Project, UPC 125495 ($356,307)

b)                     672 Pembroke Avenue Resurfacing Project, UPC 125497 ($335,327)

c)                     695 Pembroke Avenue Resurfacing Project, UPC 125503 ($370,260)

d)                     661 Pembroke Avenue Resurfacing Project, UPC 125505 ($437,359)

e)                     663 Pembroke Avenue Resurfacing Project, UPC 126105 ($547,735)

f)                     664 Pembroke Avenue Resurfacing Project, UPC 126111 ($582,557)

g)                     665 Pembroke Avenue Resurfacing Project, UPC 126112 ($243,725)

h)                     666 Pembroke Avenue Resurfacing Project, UPC 126114 ($227,252);

 

                     2.  The FY2025 Capital Budget is hereby amended to include those Projects;

 

                     3. The total sum of $3,100,522 to be received from VDOT shall be appropriated to the Capital Projects Fund for those Projects as itemized in Paragraph 1; and

                            

                     4. The City Manager or her authorized designee is hereby authorized to execute and deliver any and all documents necessary to carry out the purposes of this Resolution, subject to approval by the City Attorney.
