Purpose
PURPOSE/BACKGROUND:
The City owns property located at 8110 Orcutt Avenue (LRSN 3002700) (the “Property”). Dominion requests a 15’ wide utility easement totaling 2,650 square feet (0.0608 acre), more or less, through the Property, as depicted on the plat attached to the accompanying Right of Way Agreement, to provide electrical service to a cell tower owned by the Virginia State Police. Staff recommends approval of the easement under the terms of the attached Right of Way Agreement.
This item is exempt from the public hearing requirement under Va. Code § 15.2-1800(B)(ii).

Body
WHEREAS, the City owns property located at 8110 Orcutt Avenue (LRSN 3002700) (the “Property”);
WHEREAS, Dominion requests a 15’ wide utility easement totaling 2,650 square feet (0.0608 acre), more or less, through the Property, as depicted on the plat attached to the accompanying Right of Way Agreement, to provide electrical service to a cell tower owned by the Virginia State Police;
WHEREAS, staff recommends approval of the easement under the terms of the attached Right of Way Agreement;
WHEREAS, this item is exempt from the public hearing requirement under Va. Code § 15.2-1800(B)(ii); and
WHEREAS, the grant of the utility easement to Dominion is deemed fair and reasonable; and the terms of the Right of Way Agreement, a copy of which is attached to this Resolution, are reasonable and acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:
1. That the utility easement totaling 2,650 square feet, more or less, on City property located at 8110 Orcutt Avenue (LRSN 3002700) to Virginia Electric and Power Company is approved; and
2. That the City Manager or her designee is hereby authorized to execute the Right of Way Agreement between the City of Hampton and Virginia Electric and Power Company as set forth in this Resolution.
