Title

Resolution Authorizing the use of Construction Management Contracting for the Construction of Sanitary Sewer Force Main Replacements as Required by Hampton City Code § 2-336.1

 

Purpose

PURPOSE/BACKGROUND:

Hampton City Code § 2-336.1 allows for the use of construction management contracts for the procurement of complex projects as defined by Code of Virginia § 2.2-4379. City Council approval is required where the total project cost is expected to be less than $10,000,000.00. The Wastewater Division of the Public Works Department requests authorization from City Council to utilize a construction management contract for the following projects: PS-113 / PS-114 Sewer Force Main Replacement (Aberdeen Road), PS-005 Sewer Force Main Extension (Semple Street), PS-022 Sewer Force Main Extension (Gilbert Street), PS-026 Sewer Force Main Relocation (Markham Drive), and PS-154 Sewer Force Main Relocation (Appaloosa Court). The total cost of these projects is estimated to be $7,800,000.00. The City Manager has given her approval to proceed with the construction management procurement method determining a construction management contract to be the most practicable and fiscally advantageous procurement method for the City. Woolpert has been retained by the City to serve as the required licensed architect or engineer to assist the City on these projects.

 

Discussion:

 

Approval by City Council would allow the department to proceed with the procurement of a construction manager at risk . A two-step utilizing a request for qualifications and a request for proposals will be utilized consistent with the procedures as adopted by the Virginia Secretary of Administration. The resulting contract shall be entered into at a fixed price or not-to-exceed price. The contract shall require that (i) no more than 10 percent of the construction work, as measured by the cost of the work, be performed by the construction manager with its own forces, and (ii) the remaining 90 percent of the construction work, as measured by the cost of the work, be performed by subcontractors of the construction manager, which the construction manager shall procure by publicly advertised, competitive sealed bidding to the maximum extent practicable.

                     WHEREAS, Hampton City Code § 2-336.1 allows for the use of construction management contracts as a procurement method;

 

                     WHEREAS, The Wastewater Division of the Public Works Department desires to utilize a construction management contract for the PS-113 / PS-114 Sewer Force Main Replacement (Aberdeen Road), PS-005 Sewer Force Main Extension (Semple Street), PS-022 Sewer Force Main Extension (Gilbert Street), PS-026 Sewer Force Main Relocation (Markham Drive), PS-154 Sewer Force Main Relocation (Appaloosa Court) projects;

 

                     WHEREAS, the total cost of the projects is estimated to be $7,800,000.00;

 

                     WHEREAS, these projects have been determined to be complex projects as defined by Code of Virginia § 2.2-4379;

 

                     WHEREAS, Woolpert has been retained by the City as a licensed architect or engineer who shall advise and assist the City;

             

                     WHEREAS, the City Manager has approved the use of construction management contracts as a procurement method for these projects and determined this procurement method to be the most practicable and fiscally advantageous procurement method for the City;

 

                     WHEREAS, Hampton City Code § 2-336.1 requires City Council approval to utilize construction management contracts as a procurement method where the total project cost is less than $10,000,000.00.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:

 

                     1.                     That it approves the use of construction management contracts as a procurement method for the PS-113 / PS-114 Sewer Force Main Replacement (Aberdeen Road), PS-005 Sewer Force Main Extension (Semple Street), PS-022 Sewer Force Main Extension (Gilbert Street), PS-026 Sewer Force Main Relocation (Markham Drive), PS-154 Sewer Force Main Relocation (Appaloosa Court) projects.

 

                     2.                     That the City Manager, or her authorized designee, is authorized to execute a construction management contract and other documents that may be necessary to effectuate the intent of this resolution.

 

                     3.                     That a copy of this written approval of the City Council is maintained in the procurement file.
