Resolution to Amend the Fiscal Year 2024 Council Approved Budget to Accept and Appropriate the Increased Allocations from the Virginia Department of Transportation for the Fiscal Year 2024 Urban Maintenance Program

 

Purpose

PURPOSE/BACKGROUND:

The City Charter gives City Council the authority to approve supplemental appropriations for unanticipated state and federal revenues (see below).  This resolution appropriates additional revenue from the Commonwealth in the amount of $848,680 for the City’s FY2024 VDOT Urban Maintenance Program which funds maintenance for eligible roadway and roadway-related infrastructure maintenance activities, including traffic signals. The additional revenue is greater than that which was anticipated and budgeted in the Council Approved FY2024 budget. This resolution also contemplates and facilitates the appropriation of any additional Urban Maintenance Program Funds that may be received

                     A.                     Supplemental appropriations.  If available from surplus from previous year’s operations or from planned fund balance in the current budget as adopted, the council by resolution may make appropriations for the year not to exceed the amount of such balance.  Supplemental appropriations may also be made by council by resolution not to exceed the unanticipated revenue from the Commonwealth or federal sources where council has previously or currently approved the city’s participation in such programs.

Body

                     WHEREAS, the City of Hampton receives funding from the Virginia Department of Transportation (VDOT) on an annual basis for its Urban Maintenance Program;

 

                     WHEREAS, the Urban Maintenance Program funds maintenance activities on VDOT eligible roadway and roadway-related infrastructure within the City of Hampton;

 

                     WHEREAS, VDOT has historically provided additional annual funding for the Urban Maintenance Program not anticipated at the time of budget adoption;

 

                     WHEREAS, for the first quarter of fiscal year 2024, VDOT has allocated $848,680 more than was anticipated and budgeted in the Council Approved Fiscal Year 2024 Budget, to be used for the maintenance of traffic signals and related infrastructure on certain VDOT eligible streets; and

 

                     WHEREAS, it is anticipated that VDOT will allocate additional supplemental funding during Fiscal Year 2024. 

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA that:

                     1.                     The Fiscal Year 2024 City Council Approved Budget is amended to (a) accept $848,680 in additional Urban Maintenance revenues from VDOT, all of which shall be appropriated to the General Fund, and is hereby authorized to be transferred to the Capital Fund (Capital Projects Fund) for maintenance of traffic signals and related infrastructure on certain VDOT eligible streets; and (b) accepts and appropriates any additional Urban Maintenance Program funds received for maintenance activities on VDOT  related streets in the City of Hampton during Fiscal Year 2024, for which any allocation and/or transfer between the General Fund and the Capital Fund (Capital Projects Fund) shall be determined by the City Manager, in consultation with the Director of Finance; and

 

                     2.                     The City Manager is authorized and directed to execute any documents and take any further action necessary to implement the purposes of this resolution, subject to approval by the City Attorney.
