Resolution Authorizing the Grant of an Encroachment, Pursuant to § 34-86 of the City Code, to Richard G. Levin of Two Areas, One Comprising 144 Square Feet, and the Other, 60 Square Feet, Both Areas More or Less, Over a Portion of City Property Known as S. Hope Street (LRSN 12001367) for Outdoor Seating Areas to Accommodate the Restaurant Located at 31 E. Mellen Street (LRSN 12001388)

 

Purpose

PURPOSE/BACKGROUND:

Richard G. Levin (“Licensee”) owns a parcel of land located at 31 E. Mellen Street (LRSN 12001388) and an unimproved lot known as S. Hope Street (LRSN 12001387) upon which the Old Towne Tavern restaurant is operated.  The City owns property identified as S. Hope Street (LRSN 12001367) (the “City Property”).

 

Licensee requests the use of two areas, one comprising 144 square feet, and the other, 60 square feet, both areas more or less, over a portion of the City Property for outdoor seating areas as illustrated on Exhibit “A” to the attached Encroachment Agreement.  Both areas will have a concrete base and delineated with rope boundaries.

 

This request was routed to local utility companies and staff, none of which have any objection.  Therefore, staff recommends approval pursuant to § 34-86 of the City Code..

WHEREAS, Richard G. Levin (“Licensee”) owns a parcel of land located at 31 E. Mellen Street (LRSN 12001388) and an unimproved lot known as S. Hope Street (LRSN 12001387) upon which the Old Towne Tavern restaurant is operated;

 

WHEREAS, the City owns property identified as S. Hope Street (LRSN 12001367) (the “City Property”);

 

WHEREAS, Licensee requests the use of two areas, one comprising 144 square feet, and the other, 60 square feet, both areas more or less, over a portion of the City Property for outdoor seating areas as illustrated on Exhibit “A” to the attached Encroachment Agreement (the “Licensed Areas”);

 

WHEREAS, both Licensed Areas will have a concrete base and delineated with rope boundaries;

 

WHEREAS, City staff and local utility companies who reviewed this request have no objection; therefore, staff recommends approval; and 

 

WHEREAS, pursuant to § 34-86 of the City Code, the City agrees to grant Licensee a revocable license for the encroachment onto City-owned property under certain terms and conditions.                     

 

NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Hampton, Virginia, as follows:

 

1.                      That the Encroachment Agreement between the City of Hampton and Richard G. Levin is approved; and 

 

2.                      That the City Manager, or her authorized designee, and Clerk of Council are hereby authorized to execute and attest the Encroachment Agreement, as set forth in this Resolution.
