Resolution of Hampton City Council Initiating Amendments to the Hampton City Zoning District Map to Adjust the Boundaries of the Air Installation Compatible Use Zone Overlay District and the Noise Contour District

 

Purpose

PURPOSE/BACKGROUND:

The purpose of this item is to request City Council adoption of an initiating resolution to begin the process of amending the Hampton City Zoning District Map to adjust the boundaries of the Air Installation Compatible Use Zone Overlay District (O-AICUZ) and the Noise Contour District (Noise Overlay Map). On June 8, 2011, City Council adopted amendments to the Zoning Ordinance and City Code that established the City’s O-AICUZ overlay district and associated regulations, and also established acoustic design standards and real property disclosure requirements related to the Noise Contour District (Noise Overlay Map). Langley Air Force Base has notified the City that it is necessary to adjust the boundaries of the O-AICUZ District Map and the Noise Overlay of military operations.  City Council has determined that initiation and consideration of an amendment to the Hampton City Zoning District Map to adjust the boundaries of the O-AICUZ District and the Noise Overlay Map is required by the public necessity, and good zoning practice.

 

This initiating resolution does not itself change the zoning map; rather, it formally initiates the amendment and directs staff to prepare the proposed map changes and advance them through the required public hearing process before the Planning Commission and City Council with applicable law.

 

Discussion:

 

Adjusting the boundaries of the O-AICUZ District Map and the Noise Overlay Map supports the community by maintaining compatibility between land uses and ongoing military operations, which promotes public safety and helps reduce land use conflicts in areas affected by aircraft operations and noise exposure. The amendment process also provides transparency and predictability for residents, property owners, and applicants by ensuring the zoning district map reflects current conditions and operations at Langley Air Force Base. Virginia law provides that zoning regulations and district maps may be amended when public necessity, convenience, general welfare, or good zoning practice requires, and that amendments may be initiated by resolution of the governing body.

 

Impact:

 

Adoption of the initiating resolution is administrative and is not expected to have a direct fiscal impact because it does not itself implement the map amendment. Costs at this stage are primarily limited to staff time associated with coordination, mapping and ordinance preparation, legal review, required public notice/advertising, and processing through the public hearing schedule.

Adopt the initiating resolution formally initiating proposed amendments to the Hampton City Zoning District Map to adjust the boundaries of the O-AICUZ Overlay District and the Noise Overlay Map, and direct staff to prepare the proposed map amendment and take all steps necessary and proper to present the amendment for public hearing before the Planning Commission and City Council in accordance with applicable law.

 

Body

 

WHEREAS, the Hampton City Council adopted amendments to the Zoning Ordinance and City Code on June 8, 2011 which established the City’s Air Installation Compatible Use Zone Overlay District (“O-AICUZ”) and associated regulations, and also established acoustic design standards and real property disclosure requirements regarding the Noise Contour District, also referred to the Noise Overlay Map; and

 

WHEREAS, Langley Air Force Base has notified the City that it is necessary to adjust the boundaries of the O-AICUZ District Map and the Noise Overlay Map in order to ensure the safety of its military operations; and

 

WHEREAS, City Council has determined that initiation and consideration of an amendment to the Hampton City Zoning District Map to adjust the boundaries of the O-AICUZ District and the Noise Overlay Map is required by the public necessity, convenience, general welfare, and good zoning practice, as more particularly described above.

 

NOW, THEREFORE, BE IT RESOLVED BY HAMPTON CITY COUNCIL AS FOLLOWS:

 

1.                     The foregoing recitals are incorporated by reference herein.

 

2.                     Pursuant to Virginia Code 15.2-2286(A)(7), Hampton City Council formally initiates proposed amendments to the Hampton City Zoning District Map, specifically an amendment adjusting the boundaries of the O-AICUZ District and the Noise Overlay Map, to ensure the safety of military operations at Langley Air Force Base.

 

3.                     Community Development Department and other appropriate staff are directed to prepare the proposed amendment and to take all steps necessary and proper to present the amendment for public hearing before the Planning Commission and City Council, in accordance with applicable law.
