Title

Resolution to Amend the Fiscal Year 2024 Council Approved Budget to Accept and Appropriate the Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) Award through the Virginia Department of Emergency Management (VDEM) for the City of Hampton - North Armistead Avenue Resilience Project [FEMA-DR-4512-VA-0002]

 

Purpose

FEMA’s Hazard Mitigation Grant Program provides funding to state, local, tribal and territorial governments so they can develop hazard mitigation plans and rebuild in a way that reduces, or mitigates, future disaster losses in their communities. This grant funding is available after a presidentially declared disaster. FEMA’s Hazard Mitigation Assistance programs provide funding for eligible mitigation activities that protect life and property from future disaster damage to build a more resilient nation. FEMA provides funding through the Virginia Department of Emergency Management (VDEM) to local government.

 

The North Armistead Avenue Resilience Project, elevation of a segment of North Armistead Avenue, between Convention Center Boulevard and the LaSalle Avenue Bridge, to reduce flood related road closures and build resilience and transformation of the project area to Green-gray infrastructure by incorporating nature-based solutions along the North Armistead Avenue project area in order to slow, store and redirect stormwater. This project will reduce risk of flooding from hurricanes, nor'easters and other severe storms, as well as heavy rainfall events.

 

The City of Hampton, Department of Public Works applied to the Hazard Mitigation Grant Program, Disaster 4512, Virginia COVID-19 Pandemic in 2022 for the North Armistead Avenue Resilience Project. Of the total grant award of $13,838,664; FEMA will provide $12,520,969 ($11,861,712 for the project and $658,984 for sub-recipient management cost funds), and VDEM will provide $1,317,968. No local match is required.

A public hearing is required for this, and other budget amendment items on the agenda, because the budget amendments exceed 1% of the total adopted budget.

 

Discussion

The North Armistead Avenue Resilience Project has been designed to 90% awaiting this funding. Upon receipt of the HMGP funding, the project plans will be subject to FEMA for review and approval, prior to finalizing the plans and bidding the project for construction. It is anticipated the project will go out for bid in the Fall of 2024.

 

Impact

The City has previously received funding through the 2019 General Obligation Bond ($159,399), the Environmental Impact Bond 2020 ($1,078,685), and the Community Flood Preparedness Fund in 2022 ($1,078,685). The FEMA HMGP Award ($13,838,664) will fund the remainder of the project.

Body

WHEREAS, the Federal Emergency Management Agency (FEMA) and the Virginia Department of Emergency Management (VDEM) have awarded Hazard Mitigation Grant Program (HMPG) funding to the City of Hampton - North Armistead Avenue Resilience Project [FEMA-DR-4512-VA-002] in the amount of $12,520,969 provided by FEMA and $1,317,968 provided by VDEM, for a total of $13,838,664.00 (the "Award");

WHEREAS, the Award does not require a local cash or in-kind match;

WHEREAS, the Award will be used by the Hampton Department Public Works to fund the construction of the North Armistead Avenue Resilience Project; and

 

WHEREAS, the Award covers the period from the execution of the grant agreement through August 5, 2025.

 

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Hampton, Virginia hereby amends its Fiscal Year 2024 Council Approved Budget to accept and appropriate the Hazard Mitigation Grant Program award [FEMA-DR-4512-VA-002] in the amount of $13,838,664.00, and any related supplemental funding, from the Federal Emergency Management Agency (FEMA) and Virginia Department of Emergency Management (VDEM) to the Grant Fund, to fund the construction of the North Armistead Avenue Resilience Project.

 

BE IT FURTHER RESOLVED that the City Council authorizes the City Manager, or her designee, to take any and all actions necessary to implement this grant award.
