Resolution Requesting the Virginia Department of Transportation to Designate the North King Street Streetscape Improvement Project (Phase IV) and the Pine Chapel Road Trail Project as Urban System Highway Projects and Eligible for the Allocation of Urban Formula Funds
Purpose
PURPOSE/BACKGROUND:
Per the 2016 Budget Bill (HB 30, Chapter 780, Item 436(C)(2)), regardless of the original programmatic allocation, the Virginia Department of Transportation (“VDOT”) and the City of Hampton (the "City") may work together to consolidate unspent and/or uncommitted formula funds to fully fund and advance priority transportation projects in the City. Pursuant to VDOT Guidelines, the North King Street Streetscape Improvement Project (Phase IV) and the Pine Chapel Road Trial Project (the “Projects”) may be designated as urban system highway projects and thus eligible for the receipt of urban funds. In accordance with VDOT allocation procedures outlined in Code of Virginia § 33.2-357, City Council must support the designation of the Projects as being eligible to receive urban funds via resolution. At various times between September 11, 2006 and October 1, 2017, City Council approved the Projects for local administration. Staff recommends approval of this resolution.
Discussion:
In accordance with VDOT project allocation procedures, City Council must request by resolution the designation of the Projects as being eligible to receive urban funds. In addition, VDOT requires that by resolution, the City Council grant authority for the City Manager to execute Project Urban System Construction Program Transition Agreements and any additional agreements necessary for the implementation of the Projects. Funds awarded are paid on a reimbursement basis following the expenditure of City funds.
Impact:
Staff has requested funds for the 20% local match in the upcoming CIP budget.

WHEREAS, pursuant to VDOT Guidelines, the North King Street Streetscape Improvement Project (Phase IV) and the Pine Chapel Road Trial Project (the “Projects”) may be designated as urban system highway projects and thus eligible for the receipt of urban funds;
WHEREAS, in accordance with VDOT allocation procedures, City Council must support, by resolution, the designation of the Projects as being eligible to receive urban funds;
WHEREAS, at various times between September 11, 2006 and October 1, 2017, City Council approved the Projects for local administration; and
WHEREAS, the City requests that VDOT designate the Projects as urban system highway projects and eligible for the receipt of urban funds.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia that it requests VDOT to designate the following projects as urban system highway projects:
1) The North King Street Streetscape Improvements Project (Phase IV) (UPC 107340)
2) The Pine Chapel Road Trail Project (UPC 87010);
BE IT FURTHER RESOLVED that the Council of the City of Hampton, Virginia, agrees to pay its share of the total cost for preliminary engineering, right-of-way, and construction of these projects in accordance with Code of Virginia § 33.2-371, and that, if the City subsequently elects to cancel the Projects, the City hereby agrees to reimburse VDOT for the total amount of all its costs incurred and expended through the date the City notifies VDOT of such cancellation; and
BE IT FURTHER RESOLVED that the City Council of the City of Hampton, Virginia authorizes the City Manager or her authorized designee to execute the Project Urban System Construction Program Transition Agreements and any additional agreements necessary for the implementation of the Projects.
