Discussion:
The City of Hampton is authorized pursuant to Code of Virginia Section 15.2-2114, as it may be amended from time to time, to establish a utility or enact a system of service charges to support a local stormwater management program. That section further provides that the City may charge and collect compensation for such services. The proposed increase to the Stormwater User Fee will enable the City's Stormwater Management Fund to continue to enhance ditch maintenance and to improve the efficiency of the system.
Pursuant to Hampton City Code Section 33.3-34(c), the service charge for each residential property shall equal the rate for one equivalent residential unit ("ERU").
Pursuant to Hampton City Code Section 33.3-34(d), the service charge for each developed nonresidential property (commercial property) shall be the ERU rate multiplied by a number factor that is the total impervious surface area square footage divided by 2,429 (the square footage contained in one ERU). The number factor will then be rounded up to the nearest whole dollar if it is 0.50 or greater, or rounded down to the nearest whole number if it is less than 0.50; however in no case shall the service charge for any developed nonresidential property be less than the ERU rate.
Notice of this fee increase was included in the advertisements for the public hearings for the City Manager's Recommended Budget for Fiscal Year 2026 that ran in the Daily Press on April 13, 2025 and May 4, 2025.
Impact: The proposed increase to the Stormwater User Fee will enable the City's Stormwater Management Fund to continue to enhance ditch maintenance to improve the efficiency of the system and support the Resilient Hampton projects.

BE IT ORDAINED by the City Council of the City of Hampton, Virginia, that Section 33.3-35(c) of the City Code of the City of Hampton, Virginia be amended and restated to read as follows:

(c) The service charge due the city from property owners for stormwater management shall be based on the rate of $153.96 per ERU per year. When applicable, the service charge shall be prorated at $12.83 per ERU per month or any part thereof.
