Resolution to Accept and Appropriate $1,400,000, to be Received on a Reimbursement Basis from the City of Newport News Department of Water Works, to the Capital Projects Miscellaneous Revenue Account of the Capital Budget (Capital Project) Fund for Construction Costs of the Queens Way Streetscape Project based on a Cost Sharing Agreement to be Entered into between the City of Newport News and the City of Hampton

Purpose

The City of Hampton (“City”) is constructing streetscape improvements along East Queens Way (from Kings Way to Wine Street), East Queen Street (from Wine Street to Eaton Street) and South King Street (from Queens Way to Settlers Landing Road) known as the Queens Way Streetscape Project (the “Project”) as part of the ARPA-funded improvements in Downtown Hampton.  The City will commence construction on the Project in the Fall of 2024. The City of Newport News Waterworks Department (“NNWW”) desires to take the opportunity to replace their aging waterline at the same time to avoid impacting the City’s corridor improvements in the coming years.  As approved in Resolution 23-0335, the City already employed the City’s consultant (Kimley-Horn and Associates, Inc.) to handle the design of NNWW’s waterline and will soon be reimbursed by the City of Newport News (“Newport News”) the full costs of the waterline improvement design.  Newport News now agrees to fund the proposed NNWW improvements to be performed by the City’ s contractor during the Project.  The Project has been advertised and the City is awarding the contract to J. Sanders Construction Company.  Upon completion of construction of the Project’s pipelines, Newport News agrees to reimburse the City for actual costs incurred for the NNWW’s improvements, estimated to be $1,400,000, and they will enter into a cost sharing agreement with the City setting forth the terms and conditions for reimbursement of same.

                     WHEREAS, the City of Hampton (“City”) has applied to the City of Newport News Waterworks Department (“NNWW”) for permission to connect to its system and extend the water main or mains, constructed or intended to be constructed for the Queens Way Streetscape Project (the “Project”);

 

                     WHEREAS, the Project includes constructing streetscape improvements along East Queens Way (from Kings Way to Wine Street), East Queen Street (from Wine Street to Eaton Street) and South King Street (from Queens Way to Settlers Landing Road) as part of the ARPA-funded improvements in Downtown Hampton;

 

                      WHEREAS, the City will be commencing construction on Queens Way in the Fall of 2024;

 

                      WHEREAS, NNWW is willing to permit connection to its water system and provide retail water service;

 

                     WHEREAS, NNWW has requested to replace their aging waterline at the same time as the Project to avoid impacting the City’s corridor improvements in the coming years within the Project limits;

 

                      WHEREAS, the City included the replacement of and improvements to NNWW’s waterlines in the Invitation to Bid issued for the Project, which has since been awarded to J. Sanders Construction Co.;

 

                     WHEREAS, the City of Newport News (“Newport News”) has agreed to fund the NNWW improvements to be performed by the City’s contractor;

 

                     WHEREAS, upon completion of construction of the Project’s pipelines, the City of Newport News agrees to reimburse the City for actual costs incurred for the NNWW’s improvements, estimated to be $1,400,000;

 

                     WHEREAS, the City and Newport News will enter into a cost sharing agreement approved by the Hampton City Attorney setting forth the terms and conditions for Newport News’ reimbursement of their portion of the construction costs; and

 

                     WHEREAS, City Council needs to accept and appropriate that $1,400,000 to be received from Newport News as a reimbursement.

 

                    

                     NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, VIRGINIA, that it hereby:

 

                     1.                     Accepts and appropriates $1,400,000, and any supplemental funding that may be received from the City of Newport News as reimbursement to the City of Hampton, to the Capital Projects Miscellaneous Revenue Account of the Capital Budget (Capital Project) Fund for construction costs of NNWW’s waterlines to be installed in the Queens Way Streetscape Project; and

 

                     2.                     Authorizes the City Manager or her authorized designee to execute a cost sharing agreement between Newport News and the City and any additional contracts or agreements relating to the Project acceptable to the City Manager, and subject to approval by the City Attorney.
