Resolution to Affirm the City of Hampton, Virginia’s Use of the Virginia Juvenile Community Crime Control Act Plan Annual Contribution Awarded through the Virginia Department of Juvenile Justice and the City of Hampton's Intent to Continue to Annually Participate in the Program
Purpose
PURPOSE/BACKGROUND:
The Commonwealth of Virginia’s Department of Juvenile Justice requires localities to affirm, by resolution, the intended use of the Virginia Juvenile Community Crime Control Act (“VJCCCA”) annual contribution. The annual contribution, in the amount of up to $315,704, was previously approved and appropriated to the Court Service Unit’s operating budget as part of the fiscal year 2026 budget adoption process finalized on May 14, 2025.
Discussion:
The mission of the VJCCCA is "to deter crime by providing immediate, effective punishment that emphasizes accountability of the juvenile offender for his actions as well as reduce the pattern of repeat offending" (Code of Virginia, §16.1-309.2 et. seq.). Funding is allocated to each locality through a formula based on a variety of factors including (1) the number and types of arrests in a locality; and (2) the average daily cost for serving the child. To further ensure the continued commitment to youth, localities are also required to provide a local contribution, known as the “maintenance of effort” funding.
Development of VJCCCA plans requires consultation with judges, Court Service Unit directors and Comprehensive Services Act Community Policy and Management Teams. There are no specific types of programs or services required in a plan. The intent is for programs and services to be developed that fit the unique needs of each respective locality.
Localities are required to affirmatively endorse participation under the VJCCCA by resolution annually, unless the resolution provides that the locality intends to participate in program until written notice is provided to the Department of Juvenile Justice ("DJJ") of the desire to no longer participate. The proposed resolution includes language sufficient to support the City's continued participation until the required written notice is provided to DJJ.
Impact:
This funding allows the Court Services Unit to continue to offer programs to deter crime and recidivism for youth offenders.

WHEREAS, the City of Hampton, Virginia receives an annual contribution from the Virginia Juvenile Community Crime Control Act (“VJCCCA”) program through the Virginia Department of Juvenile Justice ("DJJ"), which may be subject to a required local contribution;
WHEREAS, the anticipated amount of $315,704, was approved and appropriated to the Court Service Unit’s operating budget as part of the budget adoption process for fiscal year 2026 (July 1, 2025 to June 30, 2026); and
WHEREAS, the City of Hampton intends to continue to participate in the VJCCCA program next year and years thereafter until written notice is provided to DJJ of a desire to no longer participate.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hampton, Virginia affirms and asserts that:
a) the Fiscal Year 2026 Virginia Juvenile Community Crime Control Act (“VJCCCA”) Plan annual contribution, in the amount up to $315,704, was approved and appropriated to the Court Service Unit’s operating budget as part of the annual budget adoption process for Fiscal Year 2026 (July 1, 2025 to June 30, 2026);
b) the City will participate in the VJCCCA program and accept funds appropriate for the purpose set forth in the VJCCCA until written notice is sent to DJJ that the City of Hampton no longer desires to participate; and
c) the City Manager, or her designee, is authorized to execute a local plan, including any revisions that may be made to a plan from time to time, and to take any and all other actions necessary to implement the purposes of this resolution.
