Ordinance To Amend And Re-Enact Chapter 8 Of The Zoning Ordinance Of The City Of Hampton, Virginia Entitled “Special Districts” By Amending Article 6 - Parks and Open Space As Part Of The Adoption Of New Zoning Districts For Fort Monroe

 

 

Purpose

Background Statement:

Chapter 8 of the zoning ordinance governs special districts in the City of Hampton. Specifically, this amendment will amend the intent statement for the Parks and Open Space General (PO-1) District.  This amendment will add “active” recreation to the list of principal purposes this district is intended to serve.  Including both “active and “passive” recreation more accurately describes the broad range of recreational activities that are permitted in this district.

 

This amendment also includes a housekeeping change to eliminate language that conflicts with the general review and approval process for rezoning requests involving nonconforming uses.

 

This amendment is part of a recommendation to amend the Hampton Community Plan (2006 as amended), rezone the Fort Monroe property, and amend the Hampton zoning ordinance to support the closure and reuse of Fort Monroe.  The Hampton Community Plan amendment (CPA 16-00001) will establish the “Fort Monroe Land Use Plan (2016)”.  The proposed rezonings include: RZ 16-00002, RZ 16-00003, RZ 16-00004, RZ 16-00005, and RZ 16-00006.  The proposed zoning ordinance amendments include: ZOA 182-2016, ZOA 183-2016, ZOA 184-2016, ZOA 185-2016, ZOA 186-2016, and ZOA 187-2016.

                     Whereas, the public necessity, convenience, general welfare and good zoning practice so require;

 

                     BE IT ORDAINED by the Council of the City of Hampton, Virginia that chapter 8 of the Zoning Ordinance of the City of Hampton, Virginia, be amended and re-enacted as follows:

 

CHAPTER 8 - SPECIAL DISTRICTS

ARTICLE 6 - PARKS AND OPEN SPACE DISTRICTS

Sec. 8-52. PO-1 District-Parks and Open Space General.

(1)                     Intent. The principal purposes of the PO-1 District are:

(a)                     To conserve and protect open space, natural environmental features, and wildlife habitat;

(b)                     To enhance the quality of life with provision of space for walking, passive and active recreation, and aesthetic enjoyment; and

(c)                     To provide for recreational opportunities, where appropriate.

Designating these areas as such will raise the degree of assurance that designated open space and recreational areas will remain. It is intended to identify those parcels, relate them to the land use element of the city's adopted comprehensive plan and major elements of existing land use characteristics, and permit the greatest certainty regarding the character of potential uses of this public land.

(2)                     Application of the district. To enable the district to operate in harmony with the plan for land use and populations embodied in these regulations, the PO-1 District shall be applied only to those lands owned or leased by the City of Hampton or any other governmental entity or political subdivision.

(3)                     Permitted uses. Uses shall be permitted as set forth in chapter 3-Uses Permitted.
