Ordinance Approving the Vacation of an Alley Intersecting 500 N. First Street, Comprising 675 Square Feet (0.0155 Acre), More or Less, to Spratley Metts Kay and Robert F. Kay, Jr. Pursuant to Chapter 34, Article V of the Code for the City of Hampton

 

 

Purpose

PURPOSE/BACKGROUND:

Spratley Metts Kay and Robert F. Kay, Jr. (“Owners”) own the property located at 500 N. First Street (LRSN 12007111) (the “Property”), which is intersected by a 15’ public alley, comprising 675 square feet (0.0155 acre), more or less (“Vacated Area”) as illustrated on Exhibit “A” attached to the accompanying Vacation Agreement.  Owners request Council’s approval to vacate the Vacated Area and all interior lot lines to enable them to demolish the existing structure and rebuild a house.  While normally the City does not vacate portions of public alleys, portions of this alley on both sides of the Vacation Area have been vacated previously. 

 

The current driveway encroaches into an area comprising 358 square feet (0.008 acre), more or less, of Owens Avenue (see Exhibit “B” attached to the accompanying Vacation Agreement).  Owners agree to remove the driveway encroachment during reconstruction and relocate the driveway wholly on the Property.

 

Pursuant to § 34-120 of the City Code, the City values the Vacation Area at Three Hundred and 00/100 Dollars ($300.00).

 

Neither staff nor the local public utility companies object to this request; therefore, staff recommends approval of this request for the purchase price of Three Hundred and 00/100 Dollars ($300.00).

WHEREAS, Spratley Metts Kay and Robert F. Kay, Jr. (“Owners”) own the property located at 500 N. First Street (LRSN 12007111) (the “Property”), which is intersected by a 15’ public alley, comprising 675 square feet (0.0155 acre), more or less (“Vacated Area”) as illustrated on Exhibit “A” attached to the accompanying Vacation Agreement;

 

WHEREAS, Owners request Council’s approval to vacate the Vacated Area and all interior lot lines to enable them to demolish the existing structure and rebuild a house;

 

WHEREAS, normally, the City does not vacate portions of public alleys; however, portions of this alley on both sides of the Vacation Area have been vacated previously;

WHEREAS, pursuant to Chapter 34, Article V of the Code for the City of Hampton, City Council agrees to vacate the alley intersecting 500 N. First Street, comprising 675 square feet (0.0155 acre), more or less, and all interior lot lines for the purchase price of Three Hundred and 00/100 Dollars ($300.00).

 

NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

 

1.                      That the vacation of the alley intersecting 500 N. First Street, comprising 675 square feet (0.0155 acre), more or less, is approved for the purchase price of $300.00.

 

2.                      That the City Manager, or her authorized designee, and Clerk of Council are authorized to execute and attest the vacation of the alley intersecting 500 N. First Street as set forth in this Ordinance; and

 

3.                     That a certified copy of this vacation ordinance shall be recorded in the Office of the Clerk of the Circuit Court for the City of Hampton, Virginia in the manner as deeds are recorded and indexed in the name of the City of Hampton.
