Resolution Approving The Grant of Permanent Sanitary Sewer Easements to the Hampton Roads Sanitation District Totaling 5,241 Square Feet (0.1203 Acre), More or Less, on City Properties located at 1505 N. Armistead Avenue (LRSN 7000123), 1507 N. Armistead Avenue (7000122), 1509 N. Armistead Avenue (7000121), 1511 N. Armistead Avenue (7000120), 1513 N. Armistead Avenue (7000119), 1515 N. Armistead Avenue (7000117), and Freeman Drive (LRSN 7000118)

 

Purpose

PURPOSE/BACKGROUND:

Approximately ten years ago, the City began purchasing properties along Freeman Drive and N. Armistead Avenue to construct the Central Park Trail.  The City had a utility easement, including a sewer gravity main and manholes, along the south and east of the properties identified as 1505 N. Armistead Avenue (LRSN 7000123), 1507 N. Armistead Avenue (7000122), 1509 N. Armistead Avenue (7000121), 1511 N. Armistead Avenue (7000120), 1513 N. Armistead Avenue (7000119), 1515 N. Armistead Avenue (7000117), and Freeman Drive (LRSN 7000118) (the “Properties”).  Once the Properties were acquired, the easement was extinguished under the doctrine of merger.

 

The nearby Home Depot pump station pumps to the Hampton Roads Sanitation District (“HRSD”) force main on N. Armistead Avenue.  Home Depot’s pump station cannot pump to HRSD’s force main when the need arises to redirect flows due to increased pressure.  HRSD requests a 10’ sanitary sewer easement along the Properties, totaling 5,241 square feet (0.1203 acre), more or less, to install a new force main from the Home Depot pump station to a gravity manhole located near its Pine Chapel pump station, thus eliminating the pressure concerns at the N. Armistead force main and permitting HRSD to send flow in two directions.

 

Staff recommends approval of this easement request.

Armistead force main and permitting HRSD to send flow in two directions; and

 

                     WHEREAS, the grant of the sanitary sewer easements to HRSD is deemed fair and reasonable; and the terms of the Deed of Sanitary Sewer Easement Dedication are reasonable and acceptable.

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:

 

1.                     That the grant of sanitary sewer easements totaling 5,241 square feet, more or less, on City properties located at 1505 N. Armistead Avenue (LRSN 7000123), 1507 N. Armistead Avenue (7000122), 1509 N. Armistead Avenue (7000121), 1511 N. Armistead Avenue (7000120), 1513 N. Armistead Avenue (7000119), 1515 N. Armistead Avenue (7000117), and Freeman Drive (LRSN 7000118) to Hampton Roads Sanitation District is approved; and

 

2.                     That the City Manager or her designee is authorized to execute the Deed of Sanitary Sewer Easement Dedication between the City of Hampton and Hampton Roads Sanitation District as set forth in this Resolution.
