Resolution to Amend the Fiscal Year 2024 Council Approved Budget and Accept and Appropriate the 2024 Part C of the Individuals with Disabilities Education Act (IDEA Grant) Funding Awarded by the Department of Behavioral Health and Developmental Services for Infants and Toddlers with Disabilities and their Families
Purpose
PURPOSE/BACKGROUND:
The purpose of this resolution is to accept and appropriate federal grant funds to permit continuation of the Part C Individuals with Disabilities Education Act (IDEA).
Discussion:
Public Law 99-457 was enacted on October 6, 1986, as an amendment of Public Law 94-142, the Education of all Handicapped Children's Act of 1975. Part H authorized the United States Department of Education to administer a discretionary grant program for states to plan, develop, and implement a statewide comprehensive, coordinated, interagency system of early intervention services to infants and toddlers with disabilities and their families. In October 1990, the 101st Congress reauthorized PL 94-142 and changed the name to the Individuals with Disabilities Education Act (IDEA).
The Infant & Toddler Connection of Hampton-Newport News (ITC) provides services to children and their families including speech/language pathology, audiology, training and counseling, respite care service, physical therapy, service coordination services, special instruction, social work services, transportation, vision services, occupational therapy, assistive technology, health and ancillary services. Total funding awarded for fiscal year 2024 is $831,533. The funding also pays for advocacy and public awareness training for professionals, as well as administrative costs for Infant & Toddler Connection staff. The City is not required to match any funds.
For the past 22 years, the City of Hampton has received the Early Intervention Services for Infants and Toddlers with Disabilities and their Families award on behalf of the Infant & Toddler Connection of Hampton-Newport News.
Congress and the Virginia General Assembly have shown a commitment to the program. IDEA was re-enacted last year and we foresee no problems with funding in the next year. We strongly support the idea that early intervention is a smart investment for the City of Hampton and Newport News when compared to the expenses associated with the long term care of individuals with a disability who have not received early intervention. The annual funding award for this program is based on the number of children enrolled for services each year. The Infant & Toddler Connection of Hampton-Newport News child count has increased almost every year, indicating an anticipated increase in our award amount in the next fiscal year.
Impact:
The grant award will help support Infants and Toddlers with Disabilities and their Families. The City has been awarded $218,620 in Federal funds and $612,913 in state funds for a total award of $831,533. No local cash or in-kind match is required. This is first year of a four-year renewable grant.

WHEREAS, the Department of Behavioral Health and Developmental Services awarded the City of Hampton, on behalf of the Infant & Toddler Connection of Hampton-Newport News, "Part C" funds pursuant to the federal Individuals with Disabilities Education Act in the amount of $831,533 (the IDEA Grant), which is comprised of $218,620 in federal funds and $612,913 in state funds;
WHEREAS, the Department of Behavioral Health and Developmental Services IDEA Grant does not require a local cash or in-kind match;
WHEREAS, the Department of Behavioral Health and Developmental Services IDEA Grant award will be used by the Infant & Toddler Connection of Hampton-Newport News to link families to "Part C" services; and
WHEREAS, the grant award is for the period of July 1, 2023 through June 30, 2024.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Hampton, Virginia hereby amends its Fiscal Year 2024 Council Approved Budget to accept and appropriate the State Fiscal Year 2024 Part C of the Individuals with Disabilities Education Act (IDEA Grant) awarded by the Department of Behavioral Health and Developmental Services for Infant and Toddlers with Disabilities and their Families in the amount of $831,533, and any supplemental funding, to the Grant Fund for the purpose of linking families to "Part C" services.
BE IT FURTHER RESOLVED that the City Council authorizes the City Manager, or her designee, to take any and all actions necessary to implement this grant award.
