Resolution Approving the City of Hampton's Participation In and Appropriation of the 2016-2017 Comprehensive Community Corrections Act and Pretrial Services Act Grant Funding Program through the Hampton-Newport News Criminal Justice Agency from the Virginia Department of Criminal Justice Services

 

Purpose

PURPOSE/BACKGROUND:

The Comprehensive Community Corrections Act for Local-Responsible Offenders, Section 9.1-173, et. seq., of the Code of Virginia, allows the City of Hampton to provide a variety of sentencing options to the Hampton General District, Juvenile and Domestic Relations, and Circuit Courts.  These services have been continually available in the City of Hampton since 1983, providing the judicial system with sentencing alternatives for certain misdemeanors and persons convicted of non-violent felonies.

 

The Hampton and Newport News Criminal Justice Agency Pretrial Services Program, which was established pursuant to the Pretrial Services Act, Section 19.2-152.2, et. seq., of the Code of Virginia, provides background investigations on defendants who are appearing before the Courts at their initial appearance and subsequent bond hearing so the Courts may make more informed pretrial incarceration and release decisions.  The program also provides supervised release for defendants while awaiting trial.  These services include thorough screening and risk assessment of pretrial detainees and supervision including substance abuse assessment, testing and treatment of eligible pretrial defendants.

 

 

Discussion:

The Hampton and Newport News Criminal Justice Agency provides local probation supervision services to offenders sentenced by the Hampton and Newport News Courts.  Additional components, including community service; batterer’s intervention; anger management; substance abuse assessment and treatment; and, shop lifting groups, are added as special conditions ordered by the Courts or by the probation officer.  Offenders are referred to the worksites to perform unpaid work as an alternative form of punishment and as an alternative to payment of court costs and fines for indigent offenders.  A variety of substance abuse tests and treatment services are available ranging from on-site testing to intensive outpatient treatment.

 

The City of Hampton cash contribution, which has been provided annually since FY95, has allowed the augmented state funding to the Hampton-Newport New Criminal Justice Agency to assist in relieving overcrowding at the Hampton City Jail.  The City of Newport News is providing cash contribution to support a portion of the salary for one full-time employee, client treatment services and peer support.

 

 

Impact:

The City of Hampton serves as the fiscal agent for the Hampton-Newport News Criminal Justice Agency.   The total grant award includes $1,919,185 in State general funds from the Department of Criminal Justice Services, $35,481 local cash contribution from the City of Hampton, $4,439 In kind match from the City of Hampton, $89,311 cash match from the City of Newport News, $98,672 In Kind match from the City of Newport News, $70,305 in client supervision fees. In addition, it is estimated that the CJA will collect $70,305 in supervision fees from offenders for fiscal year 2017. Total State funding, local funding, In kind and fees equal $2,217,393.

Approve a resolution accepting and appropriating grant funding and local cash matches from the cities of Hampton and Newport News.

                     WHEREAS, the Hampton-Newport News Criminal Justice Agency has received award notification from the Virginia Department of Criminal Justice Services on their allocation amount for the Comprehensive Community Corrections Act and Pretrial Services Act Grant, for $1,919,185 in State funds, $35,481 cash match from the City of Hampton, $4,439 In kind match from the City of Hampton, $89,311 cash match from the City of Newport News, $98,672 In Kind match from the City of Newport News, $70,305 in client supervision fees.  

 

WHEREAS, the grant award covers the period July 1, 2016 through June 30, 2017.

 

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hampton accepts and appropriates the Comprehensive Community Corrections Act and Pretrial Services Act Grant award in the amount $1,919,185 in State funds, $35,481 cash match from the City of Hampton, $4,439 In kind match from the City of Hampton, $89,311 cash match from the City of Newport News, $98,672 In Kind match from the City of Newport News, $70,305 in client supervision fees collected this granting period, for a total award of $2,217,393 along with any supplemental funding made by the Virginia Department of Criminal Justice Services in accordance with the grant agreement.

 

BE IT FURTHER RESOLVED that the City Council authorizes the City Manager, or her designee, to take the necessary steps to implement this grant award.
