Resolution Determining Imagination Playground to be the Only Source Practicably Available from which to Procure Portable Playground Equipment and Authorizing the Negotiation and Execution of a Purchase Contract with Imagination Playground as "Sole Source"

Discussion:
Imagination Playground is proprietary with an innovative concept, On-Demand training, press-kits, customer feedback cards other resources which competitors don’t offer. This Imagination Playground has numerous possibilities within the Parks, Recreation, and Leisure Services Department and it’s mobility lends itself to festivals, events, therapeutics, schools, as wells as its home-base, Bluebird Gap Farm. This playground is a great way to bring the fun back to Hampton and to show that we Love Our City.

WHEREAS, Hampton City Council recognizes the public interest in providing through its Parks, Recreation & Lesiure Services the most efficient means reasonably available and affordable to install portable playground equipment at Bluebird Gap Farm that will also be able to be utilized across the City
WHEREAS, Imagination Playground is the exclusive manufacturer of portable playground equipment which the city desires for use at Bluebird Gap Farm; and
WHEREAS, the price at which Imagination Playground has offered the portable playground equipment has been determined to be fair and reasonable.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Hampton, Virginia as follows:
1. That the contract for procuring portable playground equipment described above may be negotiated and awarded to Imagination Playground as a “sole source” without competitive sealed bidding or competitive negotiation as set forth in Virginia Code Section 2.2-4303.E;
2. That the City Manager or his authorized designee is hereby authorized to negotiate and execute a purchase contract with Imagination Playground; and
3. That the notice awarding the contract to Imagination Playground shall be posted in a public place pursuant to Virginia Code Section 2.2-4303.E.
