Resolution Determining Hampton University to be the Only Source Practically Available From Which to Procure Student Design Services Associated With the City's Plan to Construct a Memorial Honoring Dr. Martin Luther King, Jr.
Purpose
PURPOSE/BACKGROUND:
Hampton City Council plans to authorize the construction of a memorial at the existing Hampton Roads Convention Center water feature to honor the life and achievements of Dr. Martin Luther King, Jr. and local Hampton historical heroes whose vision and efforts were consistent with those of Dr. King (the "Memorial"). This Resolution will serve to determine that Hampton University is the preferred source for the design of the Memorial using the creativity of local undergraduate students.

WHEREAS, Hampton City Council plans to authorize the construction of a memorial at the existing Hampton Roads Convention Center water feature to honor the life and achievements of Dr. Martin Luther King, Jr. and local Hampton historical heroes whose vision and efforts were consistent with those of Dr. King (the “Memorial”);
WHEREAS, Hampton City Council determined the preferred source for the design of the Memorial is the creativity of local undergraduate students;
WHEREAS, Hampton University is located at 100 E. Queen Street, Hampton, Virginia 23668;
WHEREAS, Hampton University has continuously operated since April 1, 1868 when it was founded as the Hampton Normal and Agricultural Institute;
WHEREAS, the Hampton University Department of Architecture has long been recognized as one of the leading architecture programs among Historically Black Colleges and Universities and has been placing African Americans in the architectural profession for over 50 years;
WHEREAS, Hampton University embodies the vision of Dr. Martin Luther King, Jr.; and
WHEREAS, Hampton University has offered the services of its faculty and students for this purpose at a price which provides for fair and reasonable project expenses of a faculty stipend, student fact-finding travel costs, printing, supplies, and student award stipends.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:
1. That the contract for procuring the design services described above may be negotiated and awarded to Hampton University as the “sole source” without competitive sealed bidding or competitive negotiation as set forth in Code of Virginia §2.2-4303(E);
2. That the City Manager or her authorized designee is authorized to negotiate and execute a purchase contract with Hampton University; and
3. That the notice awarding the contract to Hampton University shall be posted in a public place pursuant to Code of Virginia §2.2-4303(E).
