Ordinance Vacating a Portion of a Certain Variable Width Public Right-of-Way Designated as Grant Street Containing a Total of Approximately 0.066± Acres or 2,909± Square Feet Abutting Parcels Owned by the City of Hampton and Designated as LRSNs 2000961, 2001019, 2001021, 2001025, 2001026 and 2001027

 

Purpose

Approval of this ordinance would vacate, pursuant to Section 2.05 of the City of Hampton (the “City”) Charter, an unimproved portion of Grant Street, totaling 0.066+/- acres (2,909± sq. ft.), abutting City-owned parcels designated as LRSNs 2000961, 2001019, 2001021, 2001025, 2001026 and 2001027.  There are no other property owners abutting the portion of Grant Street proposed for vacation.  A vacation agreement is not warranted since the City is the only party abutting the Grant Street Vacation Area.  This portion of Grant Street is being re-aligned and the area proposed for vacation will no longer be used as a public street.  In addition, upon approval of the vacation, the City plans to vacate and adjust the boundary lines between several adjoining parcels in the vicinity, including the vacated former right-of-way area, to result in two new parcels of property for future development. The new parcels will be approximately 7.416 acres and 0.928 acres.

Body

                     WHEREAS, the City of Hampton (the “City”) is the owner of a certain public right of way known as Grant Street, a portion of which, totaling 0.066+/- acres (2,909± sq. ft.), is proposed to be vacated and is more specifically depicted on that certain plat attached hereto and made a part hereof as Exhibit A entitled, "Plat Showing Portions of Grant Street Hereby Vacated," dated November 27, 2023, and prepared by Johnson, Mirmiran & Thompson (JMT) (the "Grant Street Vacation Area");

 

                     WHEREAS, the Grant Street Vacation Area is abutting parcels of property currently owned by the City and designated as LRSNs 2000961, 2001019, 2001021, 2001025, 2001026 and 2001027, and there are no other property owners abutting the Grant Street Vacation Area;

 

                     WHEREAS, a vacation agreement is not warranted since the City is the only party abutting the Grant Street Vacation Area;

 

                     WHEREAS, the City is in the process of re-aligning this portion of Grant Street, after which the Grant Street Vacation Area will no longer be used as a public street;

 

                     WHEREAS, the City also plans to vacate and adjust boundary lines between several adjoining parcels in the vicinity, including the Grant Street Vacation Area, to result in two new parcels of property; and

 

                     WHEREAS, the City, acting by and through its City Council pursuant to Section 2.05 of the City Charter, is of the opinion that the Grant Street Vacation Area is not now and will not be needed for public right-of-way, and its vacation is consistent with the best interests of the citizens of the City of Hampton.

 

                     NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Hampton, Virginia, as follows:

 

1.                     That the vacation of the Grant Street Vacation Area as depicted on Exhibit A is hereby approved; and

                     2.                     That the City Manager, or her authorized designee, is hereby authorized, in accordance with Section 2.05 of the City Charter, to record this ordinance, plat(s), and other related documents in the Clerk’s Office of Circuit Court for the City of Hampton, Virginia, and to take any and all actions necessary to carry out the intent of this ordinance, subject to approval by the City Attorney.
