Title

Rezoning Application by Brooks-Joseph Memory Care I, LLC and Brooks-Joseph Memory Care II, LLC to Rezone +/- 1.09 Acres Located at 1807 W Queen Street [LRSN: 3004763] from One Family Residential (R-11) District to Multifamily Residential (MD-4) District with Conditions for a Nursing Home

Purpose

Background Statement:

Rezoning Application No. 24-0431 is a request to rezone +/- 1.09 acres from One Family Residential (R-11) District to Multifamily Residential (MD-4) District for a nursing home at 1807 W. Queen Street, located just south of the intersection of W. Queen Street and E. Weaver Road. More specifically, the proposed nursing home would function as a memory care facility, providing 20 bedrooms with private bathrooms, a central living space, kitchen and dining area, an office, and two (2) staff bathrooms.  The proposed development would include a one-story structure, totaling approximately +/-11,853 square feet, and a 21-space parking area, including lighting, landscaping, and a trash enclosure.  Site amenities include landscaped garden areas with paved walking paths, private lawns, and bench seating within secured fencing.  Additional details of the proposed development can be found in the application and staff report.

The Hampton Community Plan (2006, as amended) recommends low density residential land use for the subject property.  Although the Coliseum Central Master Plan boundary runs along W. Queen Street and the site is located just outside the Plan, it is adjacent to the Power Plant Initiative area which recommends mixed-use land use.  This portion of W. Queen Street is currently a transitional corridor between the single-family neighborhood and the Power Plant commercial district that includes both low and high density residential, semi-public (i.e., churches), and commercial land uses.  The Housing and Neighborhood Policies from the Plan reference supporting housing opportunities for individuals and groups with special needs, including seniors, as well as incorporating facilities and services to meet the health care needs of persons with special needs and disabilities.

This application is in conjunction with Use Permit Application No. 24-0432, which would allow the nursing home use within the Multifamily Residential (MD-4) District with an approved Use Permit.

At the Planning Commission meeting, one person from the public spoke in favor of the application. In its deliberation, the Planning Commission asked the applicant follow up questions to better understand the relationship of the applicant and company from which the franchise would be acquired, as well as questions about security and the daily operations and living situation of the residents.
