Resolution to Amend the City Council Approved Fiscal Year 2025 Budget to Accept and Appropriate $166,718.45 Received as a Reimbursement from the City of Newport News, to the Capital Projects Wythe Fire Station Account of the Capital Project Fund for Design and Construction Costs of the Fire Station 3 Project at Kentucky Avenue Based on an Agreement between the City of Newport News and the City of Hampton.

 

Purpose

PURPOSE/BACKGROUND:

The City of Hampton (“City”) is constructing a new Fire Station at 1911 W. Pembroke Avenue known as the Fire Station 3 Project at Kentucky Avenue (the “Project”) which requires water services to be provided by the City of Newport News (“Newport News”) through its Newport News Waterworks Department (“NNWW”).  NNWW has requested the City, through the City’s contractor on the Project, to extend the water main serving the Fire Station through the Fire Station site to Kentucky Avenue terminating at an existing fire hydrant located north of a new access drive.   The betterments requested by NNWW to extend the Fire Station water main were estimated to cost $150,000.00.  Newport News agreed, pursuant to Extension Agreement No. 040-FY2023, titled “CITY OF NEWPORT NEWS, VIRGINIA WATERWORKS DEPARTMENT AGREEMENT TO EXTEND WATER MAIN AND SERVICE PIPELINE BY CONTRACTOR,” dated June 16, 2023 (the “Agreement”), to pay and reimburse the City the full costs of the water main extension, not to exceed $150,000.00, upon completion of the successful pressure test, placement of the water in service and upon receipt of an invoice from the City. Subsequent to the Agreement, NNWW requested additional work to be performed by the City’s contractor to include replacement of a fire hydrant and valve.  The cost of the change order was $16,718.45 and the change order was approved by NNWW.  The City’s contractor has completed all work on the betterments requested by Newport News.  Newport News has paid the agreed reimbursement totaling $166,718.45 to the City, and City staff requests acceptance and appropriation of the funds by City Council.

                     WHEREAS, the City of Hampton (“City”) has applied to the City of Newport News Waterworks Department (“NNWW”) for permission to connect to its system and extend the water main or mains, constructed or intended to be constructed, for the Fire Station 3 Project at Kentucky Avenue (the “Project”);

 

                     WHEREAS, NNWW is willing to permit connection to its water system and provide the City with the requested water service;

 

                     WHEREAS, NNWW desires to take the opportunity to improve the fire protection services along Kentucky Avenue during the City’s Project; 

 

                     WHEREAS, NNWW has requested the City, through the City’s contractor on the Project, to extend the water main serving the Fire Station through the Fire Station site to Kentucky Avenue terminating at an existing fire hydrant located north of a new access drive (the “Betterments”);

 

                     WHEREAS, the Betterments requested by NNWW were estimated to cost $150,000.00;

 

                     WHEREAS, the City of Newport News (“Newport News”) agreed, pursuant to Extension Agreement No. 040-FY2023, entitled “CITY OF NEWPORT NEWS, VIRGINIA WATERWORKS DEPARTMENT AGREEMENT TO EXTEND WATER MAIN AND SERVICE PIPELINE BY CONTRACTOR,” dated June 16, 2023 (the “Agreement”), to pay and reimburse the City the full costs of the water main extension, not to exceed $150,000.00, upon completion of the successful pressure test, placement of the water in service and upon receipt of an invoice from the City;

 

                     WHEREAS, subsequent to the Agreement, NNWW requested additional work to be performed by the City’s contractor to include replacement of a fire hydrant and valve and the change order was approved by NNWW;

 

                     WHEREAS, the cost of the change order was $16,718.45 bringing the total agreed to be reimbursed by Newport News to $166,718.45;

 

                     WHEREAS, the City’s contractor has completed all work on the Betterments requested by Newport News, and Newport News has now sent the agreed reimbursement totaling $166,718.45 to the City; and

 

                     WHEREAS, City Council needs to accept and appropriate $166,718.45 received from Newport News as a reimbursement. 

 

                    

                     NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAMPTON, VIRGINIA:

 

                     1.                     That the Fiscal Year 2025 Budget is hereby amended to accept and appropriate $166,718.45, received from the City of Newport News as reimbursement to the City of Hampton and held in the Committed Fund Balance of the Capital Projects Fund, to the Wythe Fire Station Account Capital Project in the Capital Projects Fund for design and construction costs of the Fire Station 3 Project at Kentucky Avenue for the aforesaid Betterments requested by Newport News; and

 

                     2.                     The City Manager or her authorized designee is authorized to execute any additional contracts or agreements relating to the Project, so long as the documents contain such terms, conditions, and modifications are acceptable to the City Manager and subject to the approval by the City Attorney.
