Ordinance to Amend and Re-Enact Chapter 9 of the City Code of the City of Hampton, Virginia Entitled, “Building and Development Regulations” by Amending Article II Pertaining to Uniform Statewide Building Code Fees

Background Statement

If approved, this amendment would update the schedule of building permit fees to promote the decrease review times, incentivize higher quality submissions, and strengthen the partnership for success while remaining competitive.

BE IT ORDAINED by the Council of the City of Hampton, Virginia that Chapter 9, Article 2 of the City Code of the City of Hampton, Virginia, be amended and re-enacted as follows with an effective date of July 1, 2020:

 

CHAPTER 9 - BUILDING AND DEVELOPMENT REGULATIONS

 

ARTICLE I. - IN GENERAL

 

ARTICLE II. - BUILDING CODE

 

DIVISION 1. - GENERALLY

Sec. 9-28. -  Adoption and enforcement.

(c)                     For purposes of this article, the term “value of construction” shall mean the total value of all costs that are directly associated with the construction, including but not limited to, demolition, materials, and labor.  In the case of donated or discounted materials or labor, the reasonable market value of such materials and labor shall be used.

DIVISION 2. - PERMIT AND INSPECTION FEES

 

Sec. 9-42. - Building Fees Generally

 

The following fees shall be charged for permits and inspections provided for in the building code with respect to work for which fees are not prescribed by other sections of this division. Beginning work without first obtaining the necessary permit shall result in a fee of fifty dollars ($50.00).

(a)                     Minimum permit fee…$50.00

 

(b)                     Reinspection fee, each…$50.00

 

(c)                     Basic permit fee. The fee shall be determined by multiplying the value of construction by thirty-nine hundredths of one percent (.39%).

(1)                      Historic Structures, as defined by the Building Code, shall have a maximum permit fee of $1,000.00

 

(d)                     Demolition permit fee:

(1)                     Accessory buildings and structures, each…$50.00

(2)                     All other buildings and structures, each…$50.00

 

(e)                     Moving structures permit fee:

(1)                     Moving structures to a location outside of the city limits: Same fee as prescribed in subsection (d)(1) and (d)(2) above.

(2)                     Moving structures to a location within the city limits: Same fee as the basic permit fee prescribed in subsection (c) above.

 

(f)                     Industrialized building permit fee: (excluding mobile units): Same as the basic permit fee prescribed in subsection (c) above.

 

(g)                     Module construction permit fee: Same as the basic permit fee in subsection (c) above.

 

(k) Plans examination: A nonrefundable fee shall be charged for the review of plans prior to making application for a permit:

(1)                     Commercial plans.....$50.00

(2)                     One and two family plans…$20.00

 

(l) Plan resubmission fee: All plan submissions subsequent to the second submission shall incur a charge of:

(1)                     Commercial plans, each…$200.00

(2)                     Residential plans, each…$100.00

 

(m) For each appeal to the building code board of appeals, the fee shall be fifty dollars ($50.00).

 

(n)                     Temporary certificate of occupancy (“TCO”):

(1)                     One and two family residential structures and Public/Semi-Public Service Facilities, including Community Centers, Hospitals, Government Facilities, etc.:

a.                     1st TCO…$100.00

b.                     2nd TCO…$200.00

c.                     Each subsequent TCO…$200.00

(2)                     All other uses:

d.                     1st TCO…$100.00

e.                     2nd TCO…$500.00

f.                     3rd TCO…$1,000.00

g.                     4th TCO…$2,000.00

h.                     Each subsequent TCO…$2,000.00

Sec. 9-43. - Electrical fees.

 

The following fees shall be charged for permits and inspections provided for in the building code with respect to electrical work. Beginning work without first obtaining the necessary permit shall result in a fee of fifty dollars ($50.00).

(a)                     Minimum permit fee… $50.00.

 

(b)                     Reinspection fee, each…$50.00.

 

(c)                     Basic permit fee: The fee shall be determined by multiplying the value of construction by a factor of nine tenths of one percent (.9%).

      (1)                      Historic Structures, as defined by the Building Code, shall have a maximum permit fee of $1,000.00

 

(d)                     Temporary service, each.....$50.00.

Sec. 9-44. - Mechanical and gas fees.

 

The following fees shall be charged for permits and inspections provided for in the building code with respect to mechanical and gas work. Beginning work without first obtaining the necessary permit shall result in a fee of fifty dollars ($50.00).

(a)                     Minimum permit fee…$50.00

 

(b)                     Reinspection fee, each…$50.00

 

(c)                     Basic permit fee: The fee shall be determined by multiplying the value of construction by a factor of nine tenths of one percent (.9%)

      (1)                      Historic Structures, as defined by the Building Code, shall have a maximum permit fee of $1,000.00

 

(d)                      Removal of fuel storage tanks, minimum, each tank…$50.00

 

(e)                     Gas connection inspection (where a permit is not required)…$25.00

 

(f)                      Fire suppression system permit fee (includes standpipes): same as basic fee prescribed in (c) above.

 

(g)                     Elevators, dumbwaiters, moving stairways, moving walks, construction personnel hoist and conveying equipment permit fee: same as basic fee prescribed in (c) above.

 

(h)                     Annual certificates of compliance for elevators (per car), escalators (per floor), dumbwaiters and man lifts…$25.00

 

(i)                     Amusement rides and devices:

(1)                     Kiddie rides ..... $25.00

(2)                     Major rides ..... $35.00

(3)                     Spectacular rides ..... $55.00

Sec. 9-45. - Plumbing fees.

 

The following fees shall be charged for permits and inspections provided for in the building code with respect to plumbing work. Beginning work without first obtaining the necessary permit shall result in a fee of fifty dollars ($50.00).

(b)                     Reinspection fee, each.....$50.00
