St. John Living Trust Dated December 8, 2022, and Any Amendments Thereto, to Allow an Encroachment into a Portion of Two City of Hampton Drainage and Utility Easements for the Installation of a Fence.
Purpose
PURPOSE/BACKGROUND:
John M. St. John and Cherrylann C. St. John, Trustees, or their successors in interest, of the John M. St. John and Cherrylann C. St. John Living Trust dated December 8, 2022, and any amendments thereto, (“Licensee”, whether one or more) owns the property located at 2 Glen Forest Drive, Hampton, Virginia 23669 (LRSN 11001186) (“Licensee’s Parcel”). Licensee’s Parcel is burdened with two (2) ten (10) foot wide existing drainage and utility easements, for the benefit of the City of Hampton (“City”), being located on the southern and western portions of Licensee’s Parcel as illustrated on that certain Exhibit “A” attached to the Encroachment Agreement presented to Council for approval (collectively the “Easement”). Licensee requested that the City grant it permission to encroach into a 133 +/- square foot (1’ wide x 133’ +/-) area of the Easement as illustrated on the aforesaid Exhibit “A” (the “Licensed Area”). The purpose of the encroachment is to install a new six (6) foot tall wood fence (the “Licensed Improvement”).
The request was routed to City staff and local utility companies, and none had any objections, but some recommend certain conditions that are included in the attached Encroachment Agreement. Therefore, pursuant to Hampton City Code § 34-86, City staff recommends approval of the Encroachment Agreement.
