Discussion:
The City of Hampton is authorized pursuant to Code of Virginia Section 15.2-2114, as it may be amended from time to time, to establish a utility or enact a system of service charges to support a local stormwater management program. That section further provides that the City may charge and collect compensation for such services. The proposed increase to the Stormwater User Fee will enable the City's Stormwater Management Fund to continue to enhance ditch maintenance and to improve the efficiency of the system.

Pursuant to Hampton City Code Section 33.3-34(c), the service charge for each developed residential property shall equal the rate for one (1) equivalent residential unit ("ERU").

Pursuant to Hampton City Code Section 33.3-34(d), the service charge for each developed nonresidential property (commercial property) shall be the ERU rate multiplied by the number factor that is the total impervious surface area square footage divided by 2,429 (the square footage contained in one ERU). The number factor will then be rounded up to the nearest whole dollar if it is 0.50 or greater, or rounded down to the nearest whole number if it is less than 0.50; however in no case shall the service charge for any developed nonresidential property be less than the ERU rate.

Notice of this fee increase was included in the advertisements for the public hearings for the City Manager's Recommended Budget for Fiscal Year 2027 that ran in the Daily Press on April 12, 2026, April 26, 2026, and May 3, 2026.
