Use Permit Application by Antionique & Twaitney Addison to Permit a Short-Term Rental (STR) at 404 N Second St [LRSN: 12007147]
Purpose
UPDATED BACKGROUND STATEMENT FOR SEPTEMBER 11, 2024:
This request is for a Use Permit for a short-term rental (STR) located at 404 N Second St [LRSN: 12007147]. The property is zoned Two-Family Residential (R-8) District.
Planning Commission originally heard and recommended approval of this case at their July 20, 2023 meeting. At the August 9, 2023 City Council meeting, City Council deferred the case along with other short-term rental Use Permit applications on the agenda until policy could be formulated related to density and distribution of short-term rentals within the City.
On June 12, 2024 and August 14, 2024, City Council adopted new Zoning Ordinance regulations establishing that policy related to short-term rentals, effective September 1, 2024. These new regulations prohibit the operation of a short-term rental within 300 feet of another short-term rental with some exceptions. The subject property does not meet any of the exceptions, and is located within 300 feet of the legally operating short-term rental at 2228 N Mallory St. Due to this proximity, this application for a Use Permit cannot be approved as the use does not comply with required additional standards contained within the Zoning Ordinance.
UPDATED BACKGROUND STATEMENT FOR JUNE 12, 2024:
This item was deferred at the August 9, 2023, the November 8, 2023, and the February 28, 2024 City Council meetings.
Based on the set of proposed amendments, the proposed short-term rental is located in the Buckroe 1 STR Zone. The proposed STR does not meet the proposed 500’ separation requirement as two (2) previously permitted STRs and their respective property boundaries are located closer than 500’ to one or more of 404 N Second Street’s property boundaries.
