Purpose
Background Statement:
This is a request to permit indoor live entertainment in conjunction with a microbrewery at 758 Settlers Landing Road [LRSN 2003231]. The property is located in the Crowne Plaza parking garage/retail center, fronting the water, and is zoned DT-2 (Downtown Waterfront) District. DT-2 allows for live entertainment in conjunction with a microbrewery with a use permit. The property also falls into the O-CB (Chesapeake Bay Overlay) District and O-FZ (Flood Zone Overlay) District. However, because the use is proposed in an existing space, there are no anticipated impacts in regards to these two overlay districts.

Staff is recommending live entertainment be allowed to operate from 11:00AM to 12:00AM Sunday through Thursday, and 11:00AM until 2:00AM on Friday and Saturday. These hours are currently more expansive than the brewery’s operating hours, but are consistent with other spaces allowing live entertainment, and provide flexibility should the brewery wish to expand its operating hours. The request is for indoor live entertainment only. Because of the operable garage-type doors on the brewery, staff recommends a set of hours in which all doors and windows must be closed if live entertainment is being provided.

The property is contained within a parking garage, providing parking in close proximity. Sufficient parking exists for the addition of the live entertainment use, and there are no concerns about vehicular circulation at the site.

The Hampton Community Plan (2006, as amended) recommends mixed use for this site and the surrounding property. The property also falls into the boundaries of the Downtown Master Plan.
