Ordinance to Repeal Chapter 32.1 of the City Code of the City of Hampton, Virginia in its Entirety and Enact Chapter 32.2 of the City Code of the City of Hampton, Virginia Entitled "Solid Waste"

Purpose
PURPOSE/BACKGROUND:
The City of Hampton’s current solid waste ordinance was enacted on January 25, 2006, whereby the City has made various small amendments over the years. Since that time, many challenges have arisen that require a more extensive overhaul of the current ordinance to allow the City’s Public Works Division to meet the City’s guiding principles of keeping the solid waste operations financially self-supporting; keeping the solid waste fees as low as possible by continuing to operate in an efficient manner; taking advantage of new technology; and continuing educational outreach and customer notifications to enhance the City’s services to the residents. The changes in the proposed new solid waste ordinance will allow City to meet the goals of the guiding principles and will enhance multiple areas of the current ordinance including but not limited to collection and violation enforcement; civil penalties; operation of the Hampton yard waste facility; evictions and move outs; portable basketball goals; and commercial recycling requirements.
Of note, this revised version of the proposed new solid waste ordinance contains civil penalties that include a warning for the first offense, a fifty dollar ($50.00) fine for the second offense, and a seventy-five dollar ($75.00) fine for the third and subsequent offenses. The effective date for the new ordinance will be July 1, 2023.
