Trietch to Allow an Encroachment into a Portion of City of Hampton Drainage Easement for the Installation of a 6-foot Privacy Fence

Purpose
PURPOSE/BACKGROUND:

Kenneth R. Trietch and Tammy Ann Gaudet a/k/a Tammy A. Trietch, (“Licensees”) own the property located at 714 Erskine Street (LRSN 4001282) (“Licensees’ Parcel”). The City of Hampton has a five (5) foot wide drainage easement along the northern property line of Licensees’ Parcel ("City Easement"). Licensees request permission to encroach into a 37.50+/- square foot area of the City Easement to replace and install a six (6) foot privacy fence, as requested in their encroachment application, and as further illustrated on Exhibit “A” attached to the Encroachment Agreement presented to Council for approval.

The request was routed to City staff and local utility companies, and none had any objections, but some recommend certain conditions that are included in the attached Encroachment Agreement. Therefore, pursuant to Hampton City Code § 34-86, City staff recommend approval of the Encroachment Agreement.

WHEREAS, Kenneth R. Trietch and Tammy Ann Gaudet a/k/a Tammy A. Trietch own property in Hampton, Virginia, referred to as 714 Erskine Street, Hampton, Virginia 23666, LRSN 4001282 (the “Licensees’ Parcel”);
WHEREAS, the Licensees’ Parcel is burdened with a five (5) foot existing drainage easement along the northern property line (“City Easement”) being for the benefit of the City of Hampton (“City”);
WHEREAS, Kenneth R. Trietch and Tammy Ann Gaudet a/k/a Tammy A. Trietch have requested permission to encroach into a 37.50 +/- square foot area of the City Easement; and...
