Ordinance To Amend And Re-Enact Chapter 2 Of The Zoning Ordinance Of The City of Hampton, Virginia Entitled, “Definitions” By Amending Section 2-2 To Add A Definition For “Retail Alcoholic Beverage Licenses”
Purpose
Background Statement:
This amendment is in response to additional authority granted by House Bill 731 (2020) & Senate Bill 676 (2020), which amended section 15.2-2286 of the Code of Virginia. As of July 1st, 2020, the City of Hampton is added to the localities that are authorized to impose a condition on use permits for businesses which have retail alcoholic beverage licenses, stating that the use permit will automatically expire upon any of the following: change in ownership of the property, change in tenant, change in operation or management of the facility (business entity change), or the passage of a specific period of time (e.g., 5 years).
This amendment adds a definition for “retail alcoholic beverage licenses” and is accompanied by a separate, related amendment to Chapter 3 (Item #20-0198), which adds a use permit requirement for certain restaurants and micro-breweries/distilleries/wineries with retail alcoholic beverage licenses from VABC.

BE IT ORDAINED by the City Council of the City of Hampton, Virginia that Section 2-2 of Chapter 2 of the Zoning Ordinance of the City of Hampton, Virginia be amended to read as follows:

Retail Alcoholic Beverage License. License issued by the Virginia Alcoholic Beverage Control Authority (VA ABC) which allows for the serving and sale of wine, beer, and mixed beverages at restaurants, hotels, convenience stores, grocery stores, gourmet shops, delicatessens and other establishments.
